(C) EXCEPTION FOR WICOMICO AND SOMERSET
COUNTIES. - IN WICOMICO AND SOMERSET COUNTIES,
EXCLUSIVE OF THE MANOKIN RIVER, ANY STATE RESIDENT
HOLDING A CURRENT TONGING LICENSE MAY CATCH OYSTERS ON
ANY LEASED OYSTER BOTTOM IF HE FIRST OBTAINS THE
WRITTEN PERMISSION OF THE LESSEE OF THE LEASED OYSTER
BOTTOM.
(D) SEASON FOR CATCHING CULTIVATED OYSTERS FOR
COMMERCIAL PURPOSES. - THE SEASON FOR CATCHING OYSTERS
FROM LEASED OYSTER BOTTOMS OF THE STATE FOR SALE SHALL
BE BETWEEN SUNRISE AND SUNSET OF ANY DAY, EXCEPT
SUNDAY, THROUGHOUT THE YEAR, IF THE LEASED OYSTER
BOTTOMS ARE MARKED AS PRESCRIBED IN THIS SUBTITLE.
REVISOR'S NOTE: Subsection (a) presently appears
as Article 66C, section 708 (g) of the Code.
The last paragraph of the present
subsection is proposed for deletion because
its substance appears in subsection (c).
Subsection (b) presently appears as Article
66C, section 708(y) of the Code. The
present reference to importing oysters of
the species Ostrea virginica is proposed
for deletion because an identical provision
appears in section 4—1115 of the revised
Code. Subsection (c) is new language
derived from the last paragraph of Article
66C, section 708 (g) of the Code. The term
"State resident" is used instead of
"citizen of the State". Apparently, this
title does not distinguish between
"citizen" and "resident" of the State and,
consequently, "resident" is used
exclusively throughout this title.
Subsection (d) presently appears as Article
66C, section 708(w) of the Code. The only
other changes made are in style.
4-1115. KIND OF OYSTERS PERMITTED; IMPORTING OYSTER
DRILLS PROHIBITED.
(A) KIND OF OYSTERS PERMITTED.—A LESSEE MAY
PLANT, CULTIVATE, SOW, OR PROTECT OYSTERS ONLY OF THE
SPECIES KNOWN AS CRASSOSTREA VIRGINICA IN THE WATERS
OF THE STATE.
(B) IMPORTATION OF OYSTER DRILLS.—A PERSON MAY
