MAY NOT EXCEED 200 ACHES IN SIZE. HOWEVER, IN THE
WATERS OF ST. MARY'S COUNTY THE DEPARTMENT MAY OPEN
MORE THAN ONE AREA IF THE TOTAL ACREAGE REMAINING OPEN
DOES NOT EXCEED 200 ACRES AND THE DEPARTMENT MAINTAINS
CONTINUOUS SURVEILLANCE WHEN DREDGING IS PERMITTED.
(C) NOTICE OF OPENING AND CLOSING REQUIRED;
EFFECTIVE DATE. - BEFORE OPENING OR CLOSING ANY AREA
THE DEPARTMENT SHALL PUBLISH NOTICE IN AT LEAST ONE
NEWSPAPER OF GENERAL CIRCULATION IN THE STATE, AND IN
AT LEAST ONE NEWSPAPER OF GENERAL CIRCULATION IN EACH
COUNTY. ANY CLOSING OR OPENING SHALL BE EFFECTIVE NO
LESS THAN 24 HOURS FROM PUBLICATION OF NOTICE.
(D) EXCEPTION FOR CHARLES AND WICOMICO COUNTIES.
- THE PROVISIONS OF THIS SECTION DO NOT APPLY TO
CHARLES AND WICOMICO COUNTIES.
REVISOR'S NOTE: This section presently appears as
Article 66C, section 713(f) of the Code and
is divided into sections for organizational
purposes. In subsection (b) the reference
to "finite geographical" areas is proposed
for deletion as superfluous because this
subtitle defines area where dredging is
permitted by specifying finite geographical
areas. The provision relating to areas
where hydraulic clam dredging is prohibited
under present subsection (j) is proposed
for deletion. The substance of this
provision is set forth in proposed
subsection (d) where the prohibited county
waters are specifically named.
In subsection (c) new language is added
requiring publication of notice in every
county because all State residents may fish
in open or closed areas as a result of
Bruce.
Article 66C, section 713(e) is proposed for
deletion because it duplicates the
provisions of this section.
The only other changes made are in style.
