FROM DREDGING, BY THIS SUBTITLE OR BY RULE OR
REGULATION OF THE DEPARTMENT, WITH ANY DREDGE, SCRAPE,
SCOOP, OR SIMILAR INSTRUMENT ON BOARD OF IN TOW, MAY
BE APPREHENDED BY ANY NATURAL RESOURCES POLICE OFFICER
OR ANY OTHER LAW ENFORCEMENT OFFICER. IF THE BOAT HAS
ON BOARD ANY SET OYSTERS, DREDGE, OR DREDGE LINE, OR
IF THE DECK IS WET AND THE BOAT IS EQUIPPED FOR
CATCHING OYSTERS WITH DREDGE OR SIMILAR INSTRUMENT,
THESE FACTS SHALL BE PRIMA FACIE EVIDENCE THAT THE
BOAT HAS BEEN USED TO VIOLATE THE PROVISIONS OF THIS
SECTION.

REVISOR'S NOTE: Subsection (a) presently appears
as Article 66C, section 702 (h) of the Code
and is set forth here for organizational
purposes. The phrase "in the Chesapeake
Bay" is proposed for deletion because any
dredging license issued under section
4-1004 authorizes its owner to dredge in
any area unless otherwise prohibited and
not solely within the Chesapeake Bay. In
addition, language is added to identify Bay
Shore and Long as oysters bars within
Parkers Rock. The reference to Lighthouse
Lump again is proposed for deletion because
this point does not appear on the
Department's chart and is in fact the same
point as Entrance Lumps.

Subsection (b) presently appears as Article
66C, section 703 (i) of the Code and set
forth here for organizational purposes.

Subsection (c) presently appears as Article
66C, section 702 (o) of the Code. The
reference to Natural Resources Police
Officer is made in light of the creation of
the Force under Chapter 348, Acts of 1972.
The phrase "any law enforcement officer" is
added because any law enforcement officer
may enforce the State laws on the waters of
the State.

The only other changes made are in style.
4-1013. DREDGING REGULATIONS AND PROHIBITIONS.

(A) DISPLAY OF LICENSE THE CAPTAIN OR MASTER

OF ANY LICENSED DREDGE BOAT ALWAYS SHALL HAVE HIS
DREDGING LICENSE ON BOARD HIS BOAT AND EXHIBIT IT UPON
DEMAND TO ANY NATURAL RESOURCES POLICE OFFICER OR ANY
