Article 66C, section 697 of the Code, as
added by Chapter 677, Acts of 1972. The
phrase "waters of the State" is substituted
for "waters of the Chesapeake Bay and its
tributaries" because the former phrase is
used repeatedly throughout this subtitle-
It seems incongruous that a person should
be prohibited from catching oysters and
clams outside the Chesapeake Bay if he
meets the license requirements and adheres
to the prohibitions and restrictions set
forth in this title. The only other
changes made are in style.
4-1004. LICENSE REQUIRED TO CATCH OYSTERS AND CLAMS
COMMERCIALLY; FEES; EXCEPTIONS.
(A) LICENSE REQUIRED. - A PERSON MAY NOT CATCH
OYSTERS OR CLAMS FOR COMMERCIAL PURPOSES IN THE WATERS
OF THE STATE UNLESS HE FIRST OBTAINS A LICENSE. A
PERSON MAY CATCH UP TO ONE BUSHEL OF OYSTERS FROM THE
NATURAL OYSTER BARS OF THE STATE FOR HIS OWN USE AND
CONSUMPTION WITHOUT A LICENSE, IN PLACES AND AT TIMES
PRESCRIBED BY RULE OR REGULATION OF THE DEPARTMENT.
(B) RESIDENCE REQUIREMENT FOR LICENSE. - A
PERSON WHO HAS BEEN A RESIDENT OF THE STATE FOR 12
MONTHS IMMEDIATELY PRECEDING HIS APPLICATION FOR A
LICENSE MAY OBTAIN A LICENSE TO CATCH OYSTERS OR CLAMS
IN THE WATERS OF THE STATE.
(C) TYPES OF LICENSES TO CATCH OYSTERS OR CLAMS
AND LICENSE FEES. - THE TYPES OF LICENSES TO CATCH
OYSTERS OR CLAMS FOR COMMERCIAL PURPOSES BY THE MEANS
ENUMERATED IN THIS SUBTITLE AND THE LICENSE FEES ARE
THE FOLLOWING:
(1) SHAFT OR HAND TONGS $25 FOR EACH PERSON
TO CATCH OYSTERS TONGING OR EMPLOYED
ON A TONG BOAT
(2) SHAFT OR HAND TONGS, $15 FOR EACH PERSON
OR RAKES TO CATCH OPERATING TONGS OR
CLAMS RAKE OR EMPLOYED ON
A TONG BOAT
(3) PATENT TONGS TO CATCH $50 FOR EACH PERSON
OYSTERS, OR TONGING OR EMPLOYED
DIVING APPARATUS
ON A PATENT TONG BOAT,
WHICH LICENSE SHALL
