reference to "State Board" is proposed for
deletion in this and subsequent subsections
and "Department" is substituted therefor
because the State Board of Health and
Mental Hygiene no longer exists.
Subsection (b) is new language derived from
Article 43, section 228B(c) of the Code.
Language is added to indicate that notice
shall be given to the appropriate governing
body of the county to allow for the
different types of governing bodies used by
the counties.
Subsection (c) presently appears as the
second and third sentences of Article 43,
section 228B(a) of the Code. Language is
added to provide that any county affected
by the restricted area may request lists
and inspections. New language also is
added to require analysis reports to be
filed with the governing body of every
affected county.
Subsection (d) presently appears as the
last sentence of Article 43, section
228B(a) of the Code.
Subsection (e) presently appears as Article
43, section 228B(d) of the Code. The
provision that requires the Health
Commissioner to report the action to the
Board of Health and Mental Hygiene is
proposed for deletion because the Board no
longer exists. New language is added to
clarify the right of the Secretary of the
Department of Health and Mental Hygiene to
delegate his authority.
Subsection (f) is new language derived from
Article 43C, section 228B (f) of the Code.
The only other changes made are in style.
4-743. QUARANTINE OF SHELLFISH.
(A) AUTHORITY OF DEPARTMENT. - TO PROTECT THE
SHELLFISH RESOURCES OF THE STATE, THE DEPARTMENT MAY
ADOPT RULES AND REGULATIONS PROHIBITING THE
IMPORTATION OF ANY SHELLFISH AND QUARANTINING ANY AREA
