674                                       LAWS OF MARYLAND                             [Ch.

WATERS OF THE STATE DURING THE CLOSED COMMERCIAL
SEASON. A PRIVATE OR COMMON CARRIER MAY NOT ACCEPT
FOR TRANSPORTATION, AND A PERSON MAY NOT TRANSPORT,
CARRY, OR CAUSE TO BE TRANSPORTED, OR CARRIED BY ANY
MEANS WALL-EYED PIKE CAUGHT IN THE TIDAL WATERS OF THE
STATE CURING THE CLOSED COMMERCIAL SEASON.

(C) EXCEPTION.—-ANY PERSON MAY POSSESS OR
TRANSPORT WALL-EYED PIKE CAUGHT BY ROD, OR HOOK AND
LINE, AT ANY TIME DURING THE YEAR.

REVISOR'S NOTE: This section presently appears as
Article 66C, section 317 of the Code. It
is divided into subsections for clarity.
Subsection (a) is redrafted for clarity.
For sports purposes, a person may fish
wall-eyed pike at any time but only by
using a rod, or hook and line.
Commercially, a person may do so only
during March 15 to November 30 in whatever
proper manner not prohibited by any other
statute. The only other changes made are
in style.

4-741. CARRYING DOMESTIC ANIMAL ON BOAT TRANSPORTING
SHELLFISH PROHIBITED,

A PERSON IN CHARGE OF ANY BOAT OR VESSEL CATCHING
OR TRANSPORTING SHELLFISH MAY NOT CARRY ON BOARD A
DOMESTIC ANIMAL OF ANY KIND.

REVISOR'S NOTE: This section presently appears as
Article 27, section 158 1/2 of the Code and
is set forth here for organizational
purposes. The penalty provision is
proposed for deletion in light of the
uniform penalty provision of this title.
The only other changes made are in style.

4-742. RESTRICTION OF POLLUTED WATERS.

(A) DEPARTMENT OF HEALTH AND MENTAL HYGIENE
AUTHORIZED TO RESTRICT AREA. - IF THE DEPARTMENT OF
HEALTH AND MENTAL HYGIENE DETERMINES BY APPROPRIATE
INVESTIGATION THAT ANY AREA OF WATERS OF THE STATE
DEVOTED TO THE PRODUCTION OR STORAGE OF SHELLFISH IS
POLLUTED SO THAT SHELLFISH PRODUCED OR STORED IN THE
AREA ARE A HAZARD TO PUBLIC HEALTH, IT SHALL RESTRICT
THE AREA FOR THE CATCHING OR STORING OF SHELLFISH. IF
THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE FINDS IT
NECESSARY TO RESTRICT AN AREA OF WATER FOR THE TAKING
