concerning the dam and its construction is
proposed for deletion as obsolete since it
does not exist.

The first provision of present subsection

(c)  relating to nonresidents of the county
and subsection (d) in its entirety are
proposed for deletion in light of Bruce v.
director, discussed in the revisor's note
to section 4-703, supra. The second
provision has been retained as subsection

(d)   since its subject matter still is
operative. The reference to "crocus" is
proposed for deletion and "croakers" is
substituted therefor because there is no
fish known as a "crocus".

The only other changes made are in style.
4-728. FISHING RESTRICTIONS IN CHESAPEAKE BAY.

(A)   USE OF NETS GENERALLY. - A PERSON MAY NOT
SET ANY NET WITHIN 1,650 FEET IN ANY DIRECTION OF ANY
OTHER NET, OR ANY NET OF A TOTAL LENGTH OF MORE THAN
1,500 FEET, INCLUDING THE NET'S LEADERS, HEDGES, OR
WINGS. IN ADDITION, A NET MAY NOT BE SET AT A
DISTANCE GREATER THAN ONE-FOURTH THE DISTANCE ACROSS
THE BAY, MEASURED FROM THE LOW WATER MARK. ALSO, A
PERSON MAY NOT SET ANY KIND OF NET IN THE WATERS IN
THE PART OF THE CHESAPEAKE BAY WHICH LIES BETWEEN A
STRAIGHT LINE DRAWN FROM DRUM POINT LIGHTHOUSE IN
CALVERT COUNTY TO HOG ISLAND IN ST. MARY'S COUNTY, AND
A STRAIGHT LINE DRAWN FROM COVE POINT LIGHTHOUSE IN
CALVERT COUNTY TO CEDAR POINT LIGHTHOUSE IN ST. MARY'S
COUNTY.

(B)   USE OF ANY POUND NET OR STAKE NET IN
HEADWATERS. - A PERSON MAY NOT SET ANY POUND NET OR
STAKE NET IN THE HEADWATERS OF THE CHESAPEAKE BAY,
EXCEPT THOSE AREAS WITHIN 2,400 FEET FROM THE NATURAL
SHORELINE IN CECIL COUNTY, THE BAY SHORE OF KENT
COUNTY UP TO HOWELL'S POINT, AND THOSE AREAS WITHIN
2,400 FEET FROM THE SHORE ON THE WEST SIDE OF THE BAY
FROM POOLES ISLAND NORTH TO ONE-HALF MILE NORTH OF
SPESUTIE ISLAND. FOR THE PURPOSE OF THIS SUBSECTION
THE HEADWATERS OF THE CHESAPEAKE BAY ARE DEFINED AS
THE WATERS EMBRACED IN THE AREA MARKED BY THE
FOLLOWING LINE:

BEGINNING AT CONCORD POINT AND RUNNING IN A
NORTHEASTERLY DIRECTION, CROSSING SUSQUEHANNA RIVER TO
