REVISOR'S NOTE: Subsection (a) presently appears
as Article 66c, section 269 (e) and (f) of
the Code. The term "contrivance" is
proposed for deletion because the
dictionary definition of "contrivance"
indicates that this term refers to a
mechanical device while "equipment" refers
to any apparatus and, therefore, would more
aptly designate any fishing device.
Subsection (b) presently appears as Article
66C, sections 292A (b) and 269(d), (d-1) of
the Code. Reference to the charts in
paragraph (2) and (3) is changed to their
last edition for the code users
convenience. The reference point referred
to in the paragraphs however, remains the
same. The last provision of section 269 (d)
is proposed for deletion since subsection
(b)(4) which is applicable to all three
bodies of water is derived from the same
language.
Subsection (c) presently appears as Article
66C, sections 292A(a) and 290 of the Code
and are set forth here because they relate
to the Severn Fiver. The tidal and
nontidal description in paragraph (1) is
proposed for deletion as explained
generally in the revisor's note in subtitle
1.
Subsection (d) presently appears as Article
66C, section 269(a), (b) , and (c) of the
Code. Subsection (d)(2) is explicitly
applicable to all months of the year like
present subsection (a).
Subsection (e) presently appears as Article
66C, section 265 (d) of the Code. The
provisions relating to the use of haul
seines in Somerset County are proposed for
deletion and placed in another section
pertaining to that county. The areas where
haul seines are prohibited are clarified by
inserting subsection numbers. The present
penalty provisions are retained since they
are greater than those in the uniform
penalty section.
The only other changes made are in style.
