(G) PROJECTING STAKES. - A PERSON KAY NOT DRIVE,
MAINTAIN, OR PERMIT ANY STAKE TO REMAIN, IN ANY LINE
OF STAKES OR OTHERWISE, UNLESS IT PROJECTS ABOVE THE
SURFACE OF THE WATER AT LEAST THREE FEET AT HIGH TIDE.

(H) DUTY TO MAINTAIN STAKES IN GOOD CONDITION;
ALLOWING STAKES TO REMAIN IN WATER; NONCOMPLIANCE WITH
SUBSECTION. - EVERY LICENSEE SHALL MAINTAIN HIS STAKES
IN GOOD CONDITION AND PROMPTLY REMOVE AND RENEW ANY
STAKE THAT MAY BE UNSOUND, BROKEN, OR LIABLE TO GO
ADRIFT. A LICENSEE MAY NOT PERMIT OR ALLOW TO REMAIN
IN THE WATER ANY POUND OR NET STAKE FOR A PERIOD
GREATER THAN 30 DAYS FOLLOWING THE REMOVAL OF THE NET
FROM EACH STAKE, OR THE DISCONTINUANCE OF FISHING OF
THE NET. IF THE LICENSEE DOES NOT COMPLY WITH THE
PROVISION OF THIS SUBSECTION, THE DEPARTMENT
IMMEDIATELY SHALL NOTIFY HIM BY REGISTERED MAIL TO
REMOVE THE STAKES WITHIN 30 DAYS AFTER RECEIPT OF THE
NOTICE. IF THE LICENSEE FAILS TO COMPLY WITH THIS
NOTICE HE IS GUILTY OF A MISDEMEANOR AND UPON
CONVICTION IS SUBJECT TO A FINE OF AT LEAST $200 AND
NOT EXCEEDING $1,000, WITH COSTS IMPOSED IN THE
DISCRETION OF THE COURT.

REVISOR'S NOTE: Subsection (a) presently appears
as Article 66C, section 264(a) of the Code.
Subsection (b) appears as Article 66C,
section 264(b).

Subsection (c) presently appears as Article
66C, section 264 (c). The second sentence
is proposed for deletion and placed in
proposed subsection (f) because it relates
to net stakes which are different than
stake nets.

Subsection (d) presently appears as Article
66C, section 264(f) and is set forth here
since it concerns nets. Subsection (e)
presently appears as Article 66C, section
264(e) of the Code.

Subsection (f) is new language and is
derived from the second sentence of Article
66C, section 264(c). This provision has
been inserted here since it relates to net
