PROCEDURE ACT, OR FOR PURPOSES OF ANY
PROVISION OF LAW PERMITTING APPEALS
TO THE COURTS FROM DECISIONS OF UNITS
INCLUDED WITHIN THE DEPARTMENT OF
NATURAL RESOURCES. APPEALS FROM
DECISIONS OF THE BOARD SHALL BE AS
PRESCRIBED IN THE ADMINISTRATIVE
PROCEDURE ACT EXCEPT IF THERE ARE
SPECIAL PROVISIONS OF LAW GOVERNING
APPEALS FROM A PARTICULAR UNIT, THOSE
PROVISIONS SHALL GOVERN APPEALS FROM
THE DECISION OF THAT UNIT.
REVISOR'S NOTE: This section is new language
derived from Article 41, section 237 of the
Code. A substantive change has been made
here by the Subcommittee when it deleted
the requirement that the complainant
petition the person who originally decided
the matter, if that person is the unit's
chief executive officer. As proposed the
complainant can directly petition the board
of review. The last sentence has been
changed to avoid a possible ambiguity of
interpretation.
SUBTITLE 2. NATURAL RESOURCES POLICE FORCE.
1-201. NATURAL RESOURCES POLICE FORCE CREATED AND
CONTINUED.
THE NATURAL RESOURCES POLICE FORCE IS CREATED AND
CONTINUED WITHIN THE DEPARTMENT.
REVISOR'S NOTE: This section is new language
derived from Article 41, section 233 (a), as
amended by Acts of 1972, which includes the
Natural Resources Police Force within the
department. The provisions relating to the
general duties and responsibilities of the
Natural Resources Police Force are set
forth here to indicate their relevancy to
the entire Natural Resources Article.
1-202. RESPONSIBILITY OF SECRETARY - IN GENERAL.
THE SECRETARY IS RESPONSIBLE FOR THE ENFORCEMENT
OF ALL NATURAL RESOURCE, LAWS OF THE STATE, INCLUDING
ANY RULES AND REGULATIONS ADOPTED PURSUANT TO THIS
