COUNTY MAY ADOPT. THE SAID BONDSMEN SO APPROVED SHALL
PAY A LICENSE FEE OF ONE (1) PERCENT OF THE GROSS
VALUE OF ALL BONDS WRITTEN IN ALL COURTS OF THE
COUNTY. THE FEE SHALL BE PAID TO THE COURT AS
PRESCRIBED BY THE RULES OF COURT. THE SAID FEE SHALL
BE USED FOR THE PAYMENT OF ANY EXPENSES INCIDENT TO
THE ADMINISTRATION OF THIS SECTION. ANY ABSOLUTE BOND
FORFEITURES COLLECTED MAY BE USED TO DEFRAY THE ABOVE
EXPENSES.

REVISOR'S NOTE: Subsection (e) is Art. 26, §30A,
which is proposed for repeal.

SECTION 9. AND BE IT FURTHER ENACTED, That new §§
617 and 619 be and they are hereby added to Art. 27,
Annotated Code of Maryland (1971 Repl. Vol. as added
to or amended by laws enacted at the 1973 regular
session of the General Assembly), title "Crimes and
Punishments", subtitle "Venue, Procedure and
Sentence", subheading "Detainers", to read as follows:

617.

(A)    ANY PERSON COMMITTED OR DETAINED, OR ANY
PERSON ON HIS BEHALF MAY DEMAND A TRUE COPY OF THE
WARRANT OF COMMITMENT OR DETAINER.

(B)   ANY OFFICER OR OTHER PERSON WHO SHALL NEGLECT
OF REFUSE TO DELIVER A TRUE COPY OF THE WARRANT OR
DETAINER, IF THERE IS ONE, WITHIN SIX HOURS AFTER THE
COPY HAS BEEN DEMANDED, SHALL FORFEIT $500 TO THE
PERSON DETAINED.

(C)   THE RIGHT OF ACTION TO RECOVER THE FORFEITURE
PROVIDED BY THIS SECTION OR BY §2-305 OF THE COURTS
AND JUDICIAL PROCEEDINGS ARTICLE SURVIVES THE DEATH OF
EITHER PARTY.

IF A CRIMINAL CASE IS REMOVED FROM ONE COUNTY TO
ANOTHER AND THE DEFENDANT IS DETAINED IN JAIL, THE
DEFENDANT MAY NOT BE TRANSFERRED TO THE COUNTY TO
WHICH THE CASE WAS REMOVED UNTIL THE FIRST DAY OF THE
SESSION OF THE COURT TO WHICH THE CASE WAS REMOVED.
