The reference to constable is also proposed
for deletion as unnecessary. Title 2, §2—606
gives a constable the same powers,
responsibilities, and liabilities as a
sheriff acting in the same capacity-
Subsection (c) contains provisions which
presently appear in §5.

SEC. 11-503. EMPLOYMENT OF AUCTIONEERS.

(A)   IN GENERAL.

EXCEPT IN HARFORD COUNTY, IF A SHERIFF IS REQUIRED
TO SELL REAL OR PERSONAL PROPERTY AS PART OF HIS
OFFICIAL DUTIES, HE KAY EMPLOY AN AUCTIONEER OF HIS
CHOICE AND CHARGE THE COSTS OF THE SALE TO THE DEBTOR.

(B)   HARFORD COUNTY.

IF THE      SHERIFF OF HARFORD COUNTY EMPLOYS AN

AUCTIONEER,    THE DEBTOR IS PRIMARILY LIABLE, BUT IF THE

PROCEEDS OF   THE SALE ARE INSUFFICIENT TO COVER THE

COSTS, THE     CREDITOR IS LIABLE FOR THE BALANCE OF THE
COSTS.

REVISOR'S NOTE: This section is new language
derived from Art. 87, §39A and §39B. The
sections are combined, and the exception for
Harford County in §39A appears in subsection
(b).

SEC. 11-504. EXEMPTION FROM EXECUTION.
(A) IN GENERAL.

EXCEPT AS PROVIDED IN SUBSECTION (B), THE
FOLLOWING ARE EXEMPT FROM EXECUTION ON A JUDGMENT:

(1)       SUBJECT TO THE PROVISIONS OF
§11-[[508]]505, $500 IN PROPERTY TO BE SELECTED BY THE
DEFENDANT, BUT NOT MORE THAN $100 IN MONEY. THE
SHERIFF SHALL OBTAIN A SIGNED APPRAISAL BY A
DISINTERESTED APPRAISES OF THE PROPERTY SELECTED BY
THE DEFENDANT. THE APPRAISAL SHALL BE RETURNED WITH
THE WRIT.

(2)    MONEY PAYABLE IN THE NATURE OF
INSURANCE, BENEFIT, OR RELIEF N THE EVENT OF
