the orphan's court. Art. 93A, §105 provides
that orphan's courts and circuit courts have
concurrent jurisdiction over protective
proceedings for minors. Additionally, Art.
93A, §§ 401 - 408 provide for supervision by
a circuit court of a tort recovery in excess
of $2,000. Whether or not these sections
include the power to approve a settlement is
unclear. Whether this section, or the Art.
93A procedures should control will be
referred to the legislature. A further
problem exists where a parent is living, but
is not available, or refuses to approve a
settlement. Approval of the court would not
be permitted under subsection (c) in such
cases.
