AGAINST AS AN ADULT.

REVISOR'S NOTE: This section is new language
derived from the waiver of jurisdiction
provisions appearing in the last sentence
of Art. 26, §76 (f) . The last sentence of
Art. 26, §76 (f) is proposed for deletion.
The provisions relating to continuing
jurisdiction appear in §4-508.

SEC. 4-507. LIMITATIONS OF JURISDICTION.

(A)   PROHIBITED JURISDICTION.

THE COURT DOES NOT HAVE JURISDICTION OVER:

(1)   A CHILD 14 YEARS OLD OR OLDER, WHO IS
ALLEGED TO HAVE DONE AN ACT WHICH, IF COMMITTED BY AN
ADULT, WOULD BE A CRIME PUNISHABLE BY DEATH OR LIFE
IMPRISONMENT (INCLUDING ANY OTHER OFFENSE ARISING OUT
OF THE SAME INCIDENT), UNLESS AN ORDER REMOVING THE
PROCEEDING TO THE JUVENILE COURT HAS BEEN FILED
PURSUANT TO §594A OF ARTICLE 27;

(2)   A CHILD 16 YEARS OLD OR OLDER, WHO IS
ALLEGED TO HAVE VIOLATED ANY PROVISION OF ANY TRAFFIC
LAW OR ORDINANCE EXCEPT THE PROVISIONS CONCERNING
MANSLAUGHTER BY AUTOMOBILE, UNAUTHORIZED USE OR
OCCUPANCY OF A MOTOR VEHICLE, TAMPERING WITH A MOTOR
VEHICLE, OR DRIVING WHILE INTOXICATED, OR DRIVING
WHILE ABILITY IS IMPAIRED BY CONSUMPTION OF ALCOHOL OR
UNDER THE INFLUENCE OF DRUGS.

(B)   CERTAIN MOTOR VEHICLE CASES.

IF THE CHILD IS CHARGED WITH TWO OR MORE
VIOLATIONS OF A TRAFFIC LAW OR ORDINANCE, ALLEGEDLY
ARISING OUT OF THE SAME INCIDENT AND WHICH WOULD
RESULT IN THE CHILD BEING BROUGHT BEFORE BOTH THE
JUVENILE COURT AND THE ADULT COURT, THE ADULT COURT
HAVING JURISDICTION OVER THE CHARGES EXCEPTED BY THIS
SECTION FROM JURISDICTION OF THE JUVENILE COURT AT ANY
STAGE OF THE PROCEEDINGS BEFORE IT, MAY ORDER THAT ANY
OF THE CHARGES BE CONSOLIDATED AND HEARD WITH THE
CHARGES BEFORE THE JUVENILE COURT.

as Art. 26, §76(e). The only changes made
are in style.

SEC. 4-508. JURISDICTION CONTINUES TO AGE 21.
