SEC. 11-407. NOTICE TO BE GIVEN BY PERMIT HOLDER TO
PRODUCER; RECORDS OF PERMIT HOLDER.

EVERY PERMIT HOLDER SHALL NOTIFY THE PRODUCER OF
THE RESULTS OF ANY TEST AND THE BASIS OF PAYMENT. HE
SHALL MAINTAIN RECORDS OF THE TESTS AND PAYMENT IN A
MANNER SPECIFIED BY THE SECRETARY.

REVISOR'S NOTE: This section presently appears as
Art. 97, §94 of the Code. The present
reference to a "person required by present
§86" is proposed for deletion and "permit
holder" is substituted for the reasons
explained in the revisor's note to §11—405.
The only other changes made are in style.

SEC. 11-408. EQUIPMENT.

WHEN DETERMINING THE WEIGHT OR MEASURE OR WHEN
TESTING MILK OR OTHER FLUID DAIRY PRODUCTS, A PERMIT

HOLDER OR LICENSEE MAY NOT USE ANY WEIGHING,

MEASURING, OR TESTING EQUIPMENT WHICH DOES NOT CONFORM
TO THE SPECIFICATIONS, TOLERANCES, AND OTHER TECHNICAL
REQUIREMENTS OF THE NATIONAL BUREAU OF STANDARDS,
HANDBOOK 44, AS AMENDED, OR THE OFFICIAL PUBLICATION
OF THE ASSOCIATION OF OFFICIAL [[AGRICULTURAL]]
ANALYTICAL CHEMISTS AS AMENDED, AND WHICH IS
INSPECTED, TESTED, AND APPROVED BY THE SECRETARY. THE
SECRETARY MAY CHARGE A REASONABLE FEE FOR EACH ITEM OF
EQUIPMENT INSPECTED.

REVISOR'S NOTE: This section presently appears as
Art. 97, §88 of the Code. The present
reference to a person subject to §86 is
proposed for deletion for the reasons
explained in the revisor's note to §11—405.
New language is added to indicate the
requirements are published in Handbook 44 of
the National Bureau of Standards. Language
is added to refer to the amended edition of
the two publications referred to in this
section. New language is added by amendment
to indicate that this provision applies to
licensees as well as permit holders. The
only other changes made are in style.

SEC. 11-409. SAMPLES; USE OF ALTERED SAMPLES AS A
BASIS FOR PAYMENT PROHIBITED.
