BASIS FOR PAYMENT OF MILK OR OTHER FLUID DAIRY
PRODUCTS.

REVISOR'S NOTE: Subsections (a) and (b) presently
appear as Art. 97, §86 of the Code. In
subsection (a), the present reference to
cooperative "association" is proposed for
deletion because §11—401(b) defines this
entity as a "cooperative". The present
provision relating to the responsibility for
records is proposed for deletion because it
appears as new language in subsection (f) .

In subsection (b), the last sentence is
proposed for deletion as obsolete. This
provision was added by Ch. 738, Acts of 1965,
and apparently was intended to exempt persons
licensed under the prior law from the
licensing provision. Although the prior law,
old Art. 43, §581, did not specifically
provide for an annual renewal of permits, it
is unlikely that any permit issued prior to
1965 is still valid.

Subsection (c) is new language derived from
the first and fourth sentences of Art. 97,
§87 of the Code.

Subsection (d) is new language derived from
the second and third sentences of Art. 97,
§87 of the Code.

Subsection (e) is new language derived from
the fifth sentence of Art. 97, §87 of the

Code.

The only other changes made are in style.
SEC. 11-405. LICENSE.

(A)   LICENSE REQUIRED TO WEIGH, MEASURE, SAMPLE OR
TEST MILK.

EVERY PERMIT HOLDER WHO PURCHASES OR RECEIVES MILK
OR OTHER FLUID DAIRY PRODUCTS ON THE BASIS OF ITS
WEIGHT, MEASURE SAMPLE OR TEST SHALL HAVE THESE
OPERATIONS PERFORMED ONLY BY INDIVIDUALS LICENSED BY
THE SECRETARY.
