reference to milk "constituent" is proposed
for deletion and "components" is substituted
for the reasons explained in the revisor's
note to §11—401(f). The present reference to
"Agricultural chemists" is proposed for
deletion and "Analytical Chemists" is added
because the latter is the proper name. The
only other changes made are in style.
SEC. 11-402. ADMINISTRATION OF SUBTITLE; RULES AND
REGULATIONS.
THE SECRETARY MAY ADOPT RULES AND REGULATIONS
NECESSARY TO REGULATE RECEIVING, WEIGHING, MEASURING,
SAMPLING, AND TESTING OF MILK OR OTHER FLUID DAIRY
PRODUCTS WHEN THE RESULTS ARE TO BE USED AS A BASIS
FOR PAYMENT FOR THESE PRODUCTS WHEN PURCHASED FROM THE
PRODUCER.
REVISOR'S NOTE: This section presently appears as
Art. 97, §84 of the Code. The present
provision requiring the State Board of
Agriculture to administer this subtitle is
proposed for deletion as obsolete. It is
superseded by §2—102. The only other changes
made are in style.
SEC. 11-403. ACCOUNTING FEES.
THE FEES PAID UNDER THIS SUBTITLE CONSTITUTE A
FUND TO DEFRAY PARTIALLY THE COSTS OF ADMINISTERING
THE PROVISIONS OF THIS SUBTITLE.
REVISOR'S NOTE: This section is new language
derived from the last sentence of Art. 97,
§91 of the Code. New language is added to
maintain consistency with similar provisions
of this Article.
SEC. 11-404. PERMIT.
(A) PERMIT REQUIRED.
ANY PERSON WHO IS ENGAGED IN THE BUSINESS OF
BUYING OR RECEIVING MILK OR OTHER FLUID DAIRY PRODUCTS
FROM THE PRODUCER OR A COOPERATIVE REPRESENTING A
PRODUCER, AND EVERY COOPERATIVE ENGAGED IN MAKING
COLLECTIVE SALES OF OR MARKETING MILK OR ITS PRODUCTS
FOR ITS MEMBERS SHALL HOLD A PERMIT FOR EACH RECEIVING
STATION.
