REVISOR'S NOTE: This section presently appears as
Art. 97, §36 of the Code. The present
reference to the "Superintendent" is proposed
for deletion and "Secretary" is substituted
for the reasons explained in the reviser's
note to §11—201. New language is added to
indicate the Secretary may exercise his
authority with respect to the weighing and
measuring of milk and fluid dairy products in
Baltimore pursuant to the provisions of
subtitle 4. The only other changes made are
in style.
SEC. 11-205. GENERAL POWERS AND DUTIES OF SECRETARY;
CONCURRENT ENFORCEMENT AUTHORITY WITH LOCAL INSPECTOR.
(A) GENERAL POWERS AND DUTIES OF SECRETARY.
THE SECRETARY SHALL:
(1) HAVE CUSTODY OF THE STATE PRIMARY
STANDARDS OF HEIGHTS AND MEASURES AND OF THE OTHER
STANDARDS AND EQUIPMENT PROVIDED FOR BY THIS SUBTITLE;
(2) KEEP ACCURATE RECORDS OF THE STANDARDS
AND EQUIPMENT;
(3) SUPERVISE THE WEIGHTS AND MEASURES
OFFERED FOR SALE, SOLD, OR USED IN THE STATE; AND
(4) SUBMIT A REPORT OF ALL THE ACTIVITIES OF
HIS OFFICE DURING THE PREVIOUS FISCAL YEAR TO THE
GOVERNOR AND LEGISLATIVE COUNCIL BY SEPTEMBER 30.
(E) CONCURRENT ENFORCEMENT AUTHORITY IN
JURISDICTION APPOINTING LOCAL INSPECTOR.
IN ANY CITY OR COUNTY WHERE A LOCAL INSPECTOR IS
PERMITTED BY THIS SUBTITLE, THE SUPERINTENDENT HAS
CONCURRENT AUTHORITY TO ENFORCE THE PROVISIONS OF THIS
TITLE.
