MATERIAL, CONSTRUCTED SO THAT THE ENTIRE CONTENTS
CANNOT BE READILY, PROPERLY, AND THOROUGHLY INSPECTED
WHILE THE PACKAGE IS CLOSED.

REVISOR'S NOTE: This subsection presently appears
as Art. 97, §60 of the Code. The only
changes made are in style.

(C) "MATURE CANTALOUPE" MEANS A CANTALOUPE WHOSE
APPEARANCE ON THE OUTSIDE INDICATES MATURITY, ARILS
SURROUNDING THE SEED HAVE BEEN ABSORBED DURING THE
DEVELOPMENT OF MATURITY, AND WHOSE JUICE OF THE EDIBLE
PORTION CONTAINS AT LEAST EIGHT PERCENT SOLUBLE SOLIDS
AS DETERMINED BY THE BALLING OR BRIX SCALE HYDROMETER.

REVISOR'S NOTE: This subsection is new language
derived from the second provision of Art. 97,
§52 of the Code.

SEC. 10-902. RULES AND REGULATIONS TO SECURE
UNIFORMITY OF ENFORCING.

THE SECRETARY MAY ADOPT AND ENFORCE ANY RULE OR
REGULATION NECESSARY TO SECURE UNIFORMITY IN THE
ENFORCEMENT OF THIS SUBTITLE AND THE PROPER MARKING OF
CLOSED CONTAINERS FOR CANTALOUPES.

REVISOR'S NOTE: This section presently appears as
Art. 97, §54 of the Code. The present
reference to the Department of Markets is
proposed for deletion because this Department
was abolished by Ch. 342, Acts of 1973. The
last clause is proposed for deletion because
the revision of the Agriculture Article
assumes that the Secretary may not adopt a
rule or regulation contrary to statute. The
only other changes made are in style.

SEC. 10-903. RIGHT OF ENTRY AND INSPECTION.

THE SECRETARY MAY ENTER EVERY PLACE, VEHICLE, OR
CONVEYANCE IN THE STATE, WHERE CANTALOUPES ARE STORED,
PACKED, DELIVERED FOR SHIPMENT, LOADED, SHIPPED,
TRANSPORTED, OFFERED OR EXPOSED FOR SALE, OR SOLD IN
CLOSED CONTAINERS. HE MAY INSPECT ANY CANTALOUPE
FOUND IN ANY OF THESE PLACES AND TAKE FOR INSPECTION
ANY REPRESENTATIVE SAMPLE OF THE CANTALOUPES AND ANY
CONTAINER NECESSARY TO DETERMINE WHETHER THIS SUBTITLE
IS VIOLATED. THE SECRETARY MAY MARK ANY CONTAINER
FOUND IN ANY PLACE, VEHICLE, OR CONVEYANCE FOR FUTURE
IDENTIFICATION.
