MARVIN MANDEL, Governor                                      1785

(3)   PREVENT THE UNAUTHORIZED OR IMPROPER USE
OF OFFICIAL TRADEMARKS OR OTHER INSIGNIA AND PROTECT
THEM FROM INFRINGEMENTS; AND

(4)   ADOPT RULES AND REGULATIONS AND TAKE ANY
ACTION NECESSARY TO EFFECTUATE THE PURPOSES OF THIS
SUBTITLE.

REVISOR'S NOTE; This section presently appears as
Art. 66C, §105 of the Code. The only changes
made are in style.

SEC. 10-503. RIGHT OF ENTRY AND EXAMINATION.

THE SECRETARY MAY ENTER ANY BUILDING, VEHICLE,
OTHER ENCLOSURE, OR CONVEYANCE IN THE STATE, WHERE ANY
FARM PRODUCT IS PRODUCED, STORED, SOLD, OR SHIPPED, OR
OFFERED, EXPOSED, PACKED, OR TRANSPORTED FOR SALE, OR
PRESENTED FOR INTRASTATE OR INTERSTATE SHIPMENT. HE
MAY EXAMINE ANY FARM PRODUCT FOUND IN ANY OF THESE
PLACES, AND MAY TAKE FOR FURTHER EXAMINATION SAMPLES
OF THE FARM PRODUCTS AND THEIR CONTAINERS NECESSARY TO
DETERMINE WHETHER THIS SUBTITLE IS VIOLATED.

REVISOR'S NOTE: This section presently appears as
Art. 66C, §106 of the Code. The present
reference to the "person whose power and duty
it is to enforce" this subtitle is proposed
for deletion because §2—104 provides that the
Secretary shall enforce the provisions of the
entire Article. The only other changes made
are in style.

SEC. 10-504. PROSECUTION..

THE STATE'S ATTORNEY OF ANY COUNTY IN WHICH ANY
VIOLATION OF THIS SUBTITLE OCCURS SHALL PROSECUTE ANY
PERSON ACCUSED OF ANY VIOLATION OF THIS SUBTITLE.
UPON THE REQUEST OF THE SECRETARY, HE SHALL INSTITUTE
AND PROSECUTE THE ACTION AS MAY BE PROPER.

REVISOR'S NOTE: This section presently appears as
Art. 66C, §108 of the Code. The present
reference to "city" is proposed for deletion
because under Art. 1, §14 and §1-101 (b) of
the Code a reference to county includes
Baltimore City, the only city that has its
own State's Attorney. The only other changes
made are in style.
