ANY COOPERATIVE AGRICULTURAL MARKETING ASSOCIATION BUT
IS NOT REQUIRES TO DO SO. THE INABILITY OF A BUYER OR
HIS REFUSAL TO MEET THE TERMS AND CONDITIONS OF ANY
COOPERATIVE AGRICULTURAL MARKETING ASSOCIATION
PROPOSED CONTRACT SHALL NOT BE INTERPRETED AS A
BOYCOTT OR DISCRIMINATION AGAINST THE COOPERATIVE
AGRICULTURAL MARKETING ASSOCIATION OR ITS MEMBERS.

REVISOR'S NOTE: This section presently appears as
Art. 66C, §60A(d) of the Code. The present
provision that states the buyer is not
required to bargain is proposed for deletion
as unnecessary. The use of the word "not"
indicates a discretionary action. The only
other changes made are in style.

SUBTITLE 3. MARYLAND STATE FAIR BOARD.

SEC. 10-301. COMPOSITION OF STATE FAIR BOARD;
APPOINTMENT; COMPENSATION; TENURE.

(A)   COMPOSITION; APPOINTMENT.

THE MARYLAND STATE FAIR BOARD IS COMPOSED OF NINE
MEMBERS. THE MEMBERS SHALL BE REPRESENTATIVE OF ALL
PHASES OF THE AGRICULTURAL INTERESTS OF THE STATE, AND
SHALL BE APPOINTED BY THE GOVERNOR, WITH THE ADVICE OF
THE SECRETARY.

(B)   SERVE WITHOUT COMPENSATION.

THE MEMBERS SHALL SERVE WITHOUT COMPENSATION.

(C)   TENURE.

THE TERM OF OFFICE OF EACH MEMBER IS THREE YEARS,
BUT ANY MEMBER APPOINTED TO FILL A VACANCY IN AN
UNEXPIRED TERM SERVES FOR THE REMAINDER OF THE TERM.
EACH MEMBER SHALL SERVE AFTER EXPIRATION OF HIS TERM
UNTIL HIS SUCCESSOR IS APPOINTED AND QUALIFIES.

REVISOR'S NOTE: This section presently appears as
Art. 66C, §61 of the Code. The present
provision creating the Board is proposed for
deletion because it duplicates the provision
of §2-106. In subsection (c) new language is
added to provide that each member serves
until his successor is appointed in order to
maintain consistency with similar sections of
this Article. The only other changes made
are in style.
