MACHINERY, OR ANY OTHER MEDIUM;
(B) LANDOWNER TO PREVENT JOHNSONGRASS
INFESTATIONS.
EACH LANDOWNER SHALL MOW, CULTIVATE, OR TREAT WITH
CHEMICALS, OR USE ANY OTHER PRACTICE PRESCRIBED BY THE
SECRETARY AS EFFECTIVE IN PREVENTING SEED SET ON ALL
JOHNSONGRASS INFESTATIONS ON HIS PROPERTY.
REVISOR'S NOTE: This section presently appears as
Art. 48, §203 of the Code. The provision
prohibiting any person from knowingly
allowing Johnsongrass to set seed on idle or
vacant land is proposed for deletion because
it is encompassed in subsection (b). The
only other changes made are in style.
SEC. 9-405. PROSECUTION.
EVERY FAILURE TO COMPLY WITH THE PROVISIONS OF
THIS SUBTITLE SHALL BE REPORTED TO THE STATE'S
ATTORNEY OF ANY COUNTY IN WHICH THE VIOLATION OCCURS.
THE STATE'S ATTORNEY SHALL PROSECUTE ALL VIOLATIONS
AND BRING AN ACTION TO ENJOIN ANY NUISANCE.
REVISOR'S NOTE: This section presently appears as
Art. 48, §204 of the Code. The present
reference to the "prosecuting officer" of the
county is proposed for deletion because the
State's attorney is the only prosecuting
officer. The present reference to city,
meaning Baltimore City, is proposed for
deletion because under Art. 1, §14 and
§1-101(b) of the Code a reference to county
includes Baltimore City. The only other
changes made are in style.
GENERAL REVISOR'S NOTE.
In the course of compiling Title 9 of the
Agriculture Article, the Governor's Commission to
Revise the Annotated Code considered the following
sections and concluded that they were not proper to be
included in the Agriculture Article. The following
treatment is proposed:
