THE STATE'S ATTORNEY OF THE COUNTY IN WHICH THE
VIOLATION OCCURRED OR OF THE ATTORNEY GENERAL OF THE
STATE SHALL INSTITUTE PROCEEDINGS AT ONCE AGAINST THE
PERSON CHARGED WITH THE VIOLATION, IF, IN HIS
JUDGMENT, THE INFORMATION WARRANTS SUCH ACTION.

(D) SECRETARY TO PUBLISH INFORMATION RELATING TO
JUDGMENT.

AFTER JUDGMENT BY THE COURT IN ANY   CASE ARISING

UNDER THIS SUBTITLE, THE SECRETARY SHALL     PUBLISH ANY

INFORMATION PERTINENT TO THE ISSUANCE OF   THE JUDGMENT
BY THE COURT IN THE MEDIA HE DESIGNATES.

REVISOR'S NOTE: This section presently appears as
Art. 48, §159 of the Code. New language,
derived from Art. 48, §148(w), is added in
subsection (b) for organizational purposes.

SUBTITLE 3. POTATO SEED INSPECTION ACT.
SEC. 9-301. DEFINITIONS.

(A)   IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

REVISOR'S NOTE: This subsection is new language
used as the standard introductory sentence to
a definition section.

(B)    "CERTIFIED IRISH POTATOES", WHEN INTENDED TO
BE USED FOR PROPAGATION PURPOSES, MEANS IRISH POTATOES
AND PARTS OF THEM WHICH CONFORM TO THE STANDARDS FIXED
BY THE SECRETARY IN CLASSIFYING AND DETERMINING WHAT
SHALL CONSTITUTE "CERTIFIED" POTATOES FOR PROPAGATION
PURPOSES AND IN CONFORMITY WITH THE RULES AND
REGULATIONS ESTABLISHED BY THE STATE IN WHICH THE
POTATOES ARE GROWN.

REVISOR'S NOTE: This subsection presently appears
as Art. 48, §190(a) of the Code. New
language is added so that this subsection
conforms to subsection (c). The present
reference to the "International Crop
Improvement Association" is proposed for
deletion and reference to the Secretary is
substituted. Since this association no
longer exists, this revision allows the
Secretary to adopt the standards of another
