(5)   THE DIVISION OR COMBINATION, OR BOTH, OF
THE PROPERTY, ASSETS AND RIGHTS WAS DECIDED UPON AND
CARRIED OUT IN ACCORDANCE WITH THIS SUBTITLE; AND

(6)    THE BOUNDARIES OF THE DISTRICT AS
DESCRIBED IN THE PETITION, OR FURTHER DEFINED BY THE
COMMITTEE.

REVISOR'S NOTE: This section is new language
derived from Art. 66C, §102(e) of the Code
which is proposed for deletion, infra. The
present provisions providing that either
statement need contain no detail other than
"mere recitals" is omitted here because it is
unnecessary. Subsections (b) and (c) are
revised to require applicants to "recite"
facts.

The present prevision requiring the
application to contain "matters required in
subsection (f)(2), (3), (4), and (5) of §92
of this subheading" is omitted here because
this section was repealed by Ch. 752, Acts of
1969. Consequently, language added in
subsection (b) (5) , (6), (7), and (8) is
derived from the previously repealed
subsection.

Likewise, in subsection (c) new language
derived from former subsection (f) is also
added to incorporate the procedures for
swearing to the application.

SEC. 8-404. CERTIFICATE OF CONSTITUTION OF DISTRICT;
POWERS OF NEW DISTRICTS AND SUPERVISORS.

(A) RECORDATION OF APPLICATIONS; ISSUANCE OF
CERTIFICATE OF CONSTITUTION OF DISTRICT.

WHEN THE SECRETARY OF STATE HAS EXAMINED,
RECEIVED, FILED, AND RECORDED THE APPLICATION, IN THE
BOOK FOR THE RECORDING OF APPLICATIONS FOR THE
ORGANIZATION OF DISTRICTS, THE OLD DISTRICTS SHALL
CEASE TO EXIST, AND THE RESULTING DISTRICTS SHALL
CONSTITUTE POLITICAL SUBDIVISIONS OF THE STATE AND
PUBLIC BODIES CORPORATE AND POLITIC. THE SECRETARY OF
STATE SHALL ISSUE TO THE SUPERVISORS OF EACH RESULTING
DISTRICT, UNDER THE SEAL OF THE STATE, A CERTIFICATE
OF CONSTITUTION BY DIVISION OR COMBINATION, OR BOTH,
OF ANY DISTRICT, AND SHALL RECORD THE CERTIFICATE WITH
THE APPLICATION AND STATEMENT.
