WORK AND PRAYING JUDGMENT WITH INTEREST. THE COURT
MAY ENTER A JUDGMENT FOR THE AMOUNT OF THE
SUPERVISOR'S COSTS AND EXPENSES, WITH INTEREST AT THE
RATE OF 5 PERCENT PER YEAR, TOGETHER WITH THE COSTS OF
SUIT, INCLUDING A REASONABLE ATTORNEY'S FEE FIXED BY
THE COURT.
REVISOR'S NOTE: This section is new language
derived from Art. 66C, §98 of the Code.
Present provisions relating to the
responsibility of the court to issue process
and serve a copy of the petition on the
defendant and its authority to take evidence,
appoint a master in equity, dismiss the
petition, and require the defendant to
perform the work are omitted here because
general laws or rules vest the court with
these responsibilities and powers. The
present provisions setting forth the content
of the bill of complaint are omitted since
pleadings are properly left to the discretion
of the draftsman. New language is added to
subsection (a) to indicate that the Circuit
Court of the County, which has equity
jurisdiction, is the appropriate court. No
reference is made to the Circuit Court of
Baltimore City because the City does not lie
within a soil conservation district.
SUBTITLE 4. DIVISION, COMBINATION, AND TERMINATION OF
DISTRICTS.
SEC. 8-401. PROCEDURE TO DIVIDE OR COMBINE DISTRICTS.
(A) PETITION TO DIVIDE OR COMBINE.
ANY DISTRICT OR DISTRICTS ORGANIZED UNDER THE
PROVISIONS OF THIS TITLE MAY BE DIVIDED OR COMBINED,
OR DIVIDED AND COMBINED WITH ANY OTHER DISTRICT OR
DISTRICTS. AT LEAST 25 LAND OCCUPIERS OF ANY DISTRICT
AFFECTED BY A PROPOSED DIVISION OR COMBINATION, OR
BOTH, SHALL SIGN AND FILE WITH THE COMMITTEE A
PETITION REQUESTING THAT ANY DISTRICT AND ITS
OPERATIONS BE DIVIDED OR COMBINED, OR BOTH, IN THE
MANNER REQUESTED. THE COMMITTEE SHALL PRESCRIBE THE
FORM OF THE PETITION.
(B) HEARINGS; DEFINITION OF PROPOSED BOUNDARIES.
THE COMMITTEE MAY CONDUCT PUBLIC MEETINGS AND
PUBLIC HEARINGS ON THE PETITION AS NECESSARY TO ASSIST
