SPECIAL MARKINGS.
(E) LOSS OF CERTIFICATE.
IF A CERTIFICATE IS LOST OR DESTROYED THE PERSON
ENTITLED TO RECEIVE THE TOBACCO BY VIRTUE OF THE
CERTIFICATE MAY MAKE OATH BEFORE A NOTARY PUBLIC THAT
THE CERTIFICATE IS LOST. THE CERTIFICATE SIGNED BY
THE NOTARY SHALL BE DEPOSITED WITH THE SECRETARY. THE
SECRETARY MAY DELIVER A NEW CERTIFICATE CORRESPONDING
WITH THE FORMER ONE AND THE SECRETARY SHALL BE
DISCHARGED FROM ANY ACTION AND DEMANDS ON ACCOUNT OF
THE FORMER CERTIFICATE.
(C) SECRETARY NOTIFIED OF LOSS WITHIN 20 DAYS.
NO PERSON MAY RECEIVE A NEW CERTIFICATE IN LIEU OF
ANY LOST OR DESTROYED CERTIFICATE UNLESS HE NOTIFIES
THE SECRETARY WITHIN 20 DAYS AFTER THE CERTIFICATE
FIRST IS DISCOVERED TO BE LOST.
REVISOR'S NOTE: Subsection (a) is new language
codifying the department's practice of
issuing a certificate of receipt after the
hogshead has been weighed. Art. 48, §26 and
§27 obviously contemplate that a certificate
be issued since they provide for the issuance
of a new certificate in case of loss or
destruction.
Subsection (b) presently appears as Art. 48,
§26 of the Code. The present reference to
any "note" is proposed for deletion
throughout this section to avoid confusion
since the department refers to a
"certificate". The present reference to a
"mislaid" certificate is proposed for
deletion because "mislaid" is synonymous with
"lost".
Subsection (c) presently appears as Art. 48,
§27 of the Code.
The only other changes made are in style.
