INFORMATION UPON DELIVERY OR REMOVAL.
(A) SECRETARY TO TAKE CHARGE OF DELIVERED
TOBACCO; RECEIPT.
THE SECRETARY SHALL TAKE CHARGE OF ANY LEAF
TOBACCO DELIVERED TO THE WAREHOUSE AND THE PARTIES
DELIVERING IT ARE ENTITLED TO RECEIVE, UPON DEMAND,
THE SECRETARY'S RECEIPT.
(E) NUMBERED HOGSHEADS; RECORDING NUMBER AND
OTHER INFORMATION UPON DELIVERY.
THE SECRETARY SHALL MARK IN SUCCESSION EACH
HOGSHEAD OF TOBACCO WITH A NUMBER WHEN IT IS DELIVERED
TO THE WAREHOUSE, AND ENTER THE NUMBER IN A BOOK KEPT
FOR THAT PURPOSE, TOGETHER WITH THE NAME OF THE OWNER
OR CONSIGNEE AND SPECIAL MARKINGS.
(C) INFORMATION RECORDED UPON REMOVAL.
WHEN THE HOGSHEAD IS REMOVED FROM THE WAREHOUSE,
THE SECRETARY SHALL ENTER IN A BOOK KEPT FOR THAT
PURPOSE, THE DATE WHEN IT IS REMOVED, THE NAME OF THE
PERSON TO WHOM IT IS DELIVERED, AND THE CONVEYANCE BY
WHICH IT IS TAKEN AWAY.
REVISOR'S NOTE: Subsection (a) presently appears
as Art. 48, §15 of the Code. The reference
to the warehouses in Baltimore City is
proposed for deletion because they no longer
exist.
Subsections (b) and (c) presently appear as
Art. 48, §16 of the Code. New language is
added to specifically indicate that each
hogshead shall be inscribed with a number.
In subsection (b) the present requirement
that the time of receipt and the name of the
conveyance be recorded is proposed for
deletion. The department has not recorded
this information for at least 13 years
because it is not necessary as they issue a
certificate of receipt to the owner, inscribe
a number on the hogshead, and record other
information as provided by this section.
According to the Department, these acts are
sufficient to adequately identify any
hogshead. The present reference to marking
the initials or other identifying trademarks
or other markings is proposed for deletion
