REVISOR'S NOTE: Subsections (a) and (b) presently
appear as Art.. 66C, §474 (a) of the Code. The
present reference to "brand" is proposed for
deletion, and "product name" is substituted
in this and subsequent sections because soil
conditioners do not have "brands".
Subsection (c) is new language added to
codify present department practice. The
annual registration fees prescribed by §6-208
clearly indicate that each registration
terminates within a year.
Subsection (d) presently appears as Art. 66C,
§474 (b) and (c) of the Code.
The only other changes made are in style.
SEC. 6-208. REGISTRATION AND INSPECTION FEES;
EXEMPTIONS.
(A) FEES.
[[(1)]] FOR EACH BRAND AND GRADE OF
COMMERCIAL FERTILIZER AND FOR EACH SOIL CONDITIONER
DISTRIBUTED IN THE STATE, THE ANNUAL REGISTRATION FEE
IS $10 AND THE ANNUAL INSPECTION FEE IS 15 CENTS PER
TON[[ . ]] EXCEPT
[[(2)]] (1) FOR EACH BRAND AND GRADE OF
COMMERCIAL FERTILIZER AND EACH SOIL CONDITIONER
DISTRIBUTED IN PACKAGES OF TEN POUNDS OR LESS, THE
ANNUAL REGISTRATION FEE IS $25, NOTWITHSTANDING ANY
OTHER REGISTRATION OR INSPECTION FEE[[.]] AND
[[(3)]] (2) FOR EACH BRAND AND GRADE OF
COMMERCIAL FERTILIZER AND EACH SOIL CONDITIONER
DISTRIBUTED IN PACKAGES OF TEN POUNDS OR LESS AND IN
PACKAGES OVER TEN POUNDS, THE ANNUAL $25 REGISTRATION
FEE APPLIES, AND ONLY THE PORTION DISTRIBUTED IN
PACKAGES OVER TEN POUNDS IS SUBJECT TO THE INSPECTION
FEE OF 15 CENTS PER TON.
(B) EXEMPTIONS.
(1) MIXED-TO-ORDER, BUYER'S MIXTURE, OR
CUSTOM-MIX FERTILIZER IS EXEMPTED FROM THE
REGISTRATION FEE, BUT THE INSPECTION FEE SHALL BE
PAID.
(2) DISTRIBUTION OF FERTILIZER MATERIALS TO
