(B)   SHIPMENTS WITHOUT A CERTIFICATE.

IF A COLONY OF BEES IS SHIPPED OR TRANSPORTED INTO
THE STATE FROM ANY STATE OR FOREIGN COUNTRY WITHOUT A
WRITTEN CERTIFICATE, THE CONSIGNEE, UPON RECEIPT OF
THE COLONY, IMMEDIATELY SHALL NOTIFY THE SECRETARY OF
ITS RECEIPT. THE SECRETARY IMMEDIATELY SHALL INSPECT
THE COLONY.

(C)   EXCEPTION FOR QUEEN BEES NOT ACCOMPANIED BY
BROOD OR COME.

THIS SECTION DOES NOT PROHIBIT TRANSPORTATION OR
DELIVERY OF QUEEN BEES NOT ACCOMPANIED BY BROOD OR
COMB.

REVISOR'S NOTE: Subsection (a) presently appears
as the first sentence of Art. 48, §106 of the
Code. The present reference to "any state or
foreign country having an inspector of
apiaries" is proposed for deletion because
this subsection is concerned with the
certificate requirement. If a state or
foreign country does not have an inspector,
then subsection (b) is applicable.

Subsection (b) presently appears as the
second sentence of Art. 48, §106 of the Code.

Subsection (c) is new language derived from
the last sentence of Art. 48, §106 of the
Code.

The third and fourth sentences of Art. 48,
§106 appear as new language in §5—507.

The only other changes made are in style.

SEC. 5-507. DELIVERY OF COLONIES NOT ACCOMPANIED BY
CERTIFICATE; COMMON CARRIER NOT LIABLE FOR
NON-DELIVERY.

NO TRANSPORTATION COMPANY OR COMMON CARRIER MAY
ACCEPT FOR TRANSPORTATION INTO THE STATE OR DELIVER
ANY COLONY OF BEES FROM A STATE OR FOREIGN COUNTRY,
UNLESS THE COLONY IS ACCOMPANIED BY A CERTIFICATE OF
INSPECTION. NO TRANSPORTATION COMPANY OR COMMON
CARRIER IS LIABLE FOR DAMAGES TO THE CONSIGNEE OR
CONSIGNOR FOR REFUSING TO RECEIVE A COLONY NOT
ACCOMPANIED BY A CERTIFICATE.
