SUBTITLE 4. MOSQUITO CONTROL.
SEC. 5-401. ACQUISITION OF PROPERTY.
THE SECRETARY, IN THE NAME OF THE STATE, MAY
ACQUIRE FOR ITS USE PROPERTY RIGHTS OF ANY KIND BY
GIFT, PURCHASE, OR CONDEMNATION FROM THE OWNER, AS IT
DEEMS DESIRABLE OR NECESSARY FOR THE PURPOSE OF
CARRYING OUT THE PROVISIONS OF THIS SUBTITLE.
REVISOR'S NOTE: This section presently appears as
Art. 48, §90 of the Code. The present
reference to the "State Board of Agriculture
and the State Entomologist or its duly
authorized officer or agent" is proposed for
deletion in light of the new department
organization. Ch. 342, Acts of 1972 provides
that the Secretary is responsible for the
administration of the department; See Art.
41, §430. The office of the State
Entomologist is abolished; See Art. 41, §432.
Consequently, this section is revised to vest
all powers, duties, and responsibilities in
the Secretary. The only other changes made
are in style.
SEC. 5-402. ACCEPTANCE OF GIFTS OR LOANS FROM FEDERAL
GOVERNMENT.
THE SECRETARY MAY ACCEPT, USE, OR EXPEND, ON TERMS
SATISFACTORY TO HIM, ANY AID, GIFT, OR LOAN MADE
AVAILABLE, BY THE GOVERNMENT OF THE UNITED STATES OR
ANY AGENCY OF IT, FOR THE PURPOSE OF CARRYING OUT THE
PROVISIONS OF THIS SUBTITLE.

SEC. 5-403. SECRETARY MAY EXECUTE SUBTITLE BY
CONTRACT OR OPEN ACCOUNT.
THE SECRETARY MAY EXECUTE WORK UNDERTAKEN PURSUANT
TO THIS SUBTITLE BY CONTRACT OR OPEN ACCOUNT, AS HE
DEEMS TO BE IN THE STATE'S BEST INTEREST.
