(B) DESTRUCTION OF INFESTED OR INFECTED PLANTS.

IF, WITHIN TEN DAYS AFTER NOTIFICATION, THE PERSON
NOTIFIED DOES NOT DESTROY OR TREAT THE INFESTED OR
INFECTED PLANT PURSUANT TO THE DEPARTMENTAL RULES AND
REGULATIONS, THE SECRETARY SHALL DESTROY OR TREAT THE
PLANT. THE SECRETARY SHALL PREPARE A STATEMENT OF THE
EXPENSES OF DESTRUCTION OR TREATMENT AND SHALL
TRANSMIT A COPY OF THE STATEMENT AND ACCOUNT TO THE
STATE'S ATTORNEY OF THE COUNTY WHERE THE OWNER OF THE
PREMISES RESIDES. THE STATE'S ATTORNEY SHALL COLLECT
THE EXPENSES AND ACCOUNT TO THE SECRETARY. THE COPY
OF THE STATEMENT AND ACCOUNT IS SUFFICIENT EVIDENCE TO
PROVE THE CLAIM.

REVISOR'S NOTE: This section presently appears as
Art. 48, §77 of the Code. In subsection (b),
the present reference to the rules and
regulations of the "trustees" is proposed for
deletion because it is obsolete. This
reference originates from the time when the
"trustees" of the University of Maryland were
responsible for administering this subtitle.
The infested or infected nursery stock must
be destroyed pursuant to the "departmental
rules and regulations". The only other
changes made are in style.

SEC. 5-308. RECIPROCAL AGREEMENTS FOR NURSERY STOCK.

THE SECRETARY MAY ENTER INTO RECIPROCAL AGREEMENTS
WITH OTHER STATES TO PROVIDE THAT SHIPMENTS OF
MARYLAND NURSERY STOCK SHALL BE RECEIVED ON THE SAME
BASIS AS THE NURSERY STOCK OF OTHER STATES IS RECEIVED
IN MARYLAND UNDER THE PROVISIONS OF THIS SUBTITLE.

SEC. 5-309. INSPECTION OF NURSERIES; CERTIFICATE;
DESTRUCTION OF DISEASED NURSERY STOCK.

(A) INSPECTION OF NURSERIES.

THE SECRETARY SHALL INSPECT AT   LEAST ONCE EVERY

[[SIX MONTHS]] YEAR ALL NURSERIES     SUSCEPTIBLE TO

DANGEROUSLY INJURIOUS INSECTS, OTHER   ANIMAL PESTS, OR
PLANT DISEASES IN THE STATE.
