reference to the State Chemist is proposed
for deletion throughout this section and
"Secretary" is substituted for the reason
explained in the revisor's note to §5—102.
The second sentence of §132(a) also is
proposed for deletion because it is
unnecessary in light of the provisions of
revised subsection (a).
Subsection (b) presently appears as the third
sentence of Art. 48, §132(a) of the Code.
Subsection (c) is new language derived from
the last two sentences of Art. 48, §132(a) of
the Code and added to indicate that a
separate application must be filed for each
whose name appears on the label.
Subsection (d) presently appears as Art. 48,
§132(b) of the Code. The present provision
stating that the fee is exclusive of
penalties is proposed for deletion because it
is unnecessary. In addition, the present
reference to the fund is proposed for
deletion because it duplicates the provisions
of §5-103.
Subsection (e) presently appears as Art. 48,
§136(a) of the Code. New language is added
to indicate to the Code user that a late fee
must be paid in addition to the annual fee.
Subsection (f) presently appears as Art. 48,
§132 (c) of the Code.
Subsection (g) presently appears as Art. 48,
§132 (e) of the Code.
The only other changes made are in style.
SEC. 5-106. PACKAGING, LABELING, AND COLORING
REQUIREMENTS.
(A) PESTICIDES SUBJECT TO THIS SECTION.
A PESTICIDE IS SUBJECT TO THE REQUIREMENTS OF THIS
SECTION IF IT IS DISTRIBUTED, SOLD, OFFERED FOR SALE,
DELIVERED FOR TRANSPORTATION OR TRANSPORTED IN
INTRASTATE COMMERCE OR BETWEEN POINTS IN THE STATE
THROUGH ANY POINT OUTSIDE THE STATE.
