THE STATE CHEMIST SHALL ADMINISTER THE PROVISIONS
OF THIS SUBTITLE SUBJECT TO THE SUPERVISION OF THE
SECRETARY.
(B) COOPERATION WITH STATE, FEDERAL, AND PRIVATE
AGENCIES.
THE SECRETARY MAY COOPERATE WITH AND ENTER INTO
AGREEMENTS WITH ANY OTHER AGENCY OF THE STATE, ANY
OTHER STATE, THE UNITED STATES, OR WITH THE
ASSOCIATION OF AMERICAN PESTICIDE CONTROL OFFICIALS,
INC. TO CARRY OUT THE PROVISIONS OF THIS SUBTITLE AND
TO SECURE UNIFORM RULES AND REGULATIONS.
REVISOR'S NOTE: Subsection (a) is new language
derived from the second sentence of Art. 48,
§129 of the Code. All other present
references to the State Chemist in this
subtitle are proposed for deletion to reflect
the departmental organization which includes
the State Chemist as a unit within the
department. This section is retained to
indicate clearly to the Code user that the
State Chemist has the authority to administer
this subtitle. However, language is added to
reflect the fact that the Secretary has the
ultimate responsibility for administering
this Article; See Art. 41, §430.
Subsection (b) presently appears as Art. 48,
§139 of the Code and is set forth here for
organizational purposes. The only other
changes made are in style.
SEC. 5-103. FUND.
THE REGISTRATION FEE AND ALL LATE FEES UNDER THIS
SUBTITLE SHALL BE PLACED IN A FUND TO DEFRAY PARTIALLY
THE COST OF ADMINISTERING THIS SUBTITLE. ANY
UNEXPENDED FUNDS SHALL REVERT TO THE GENERAL FUNDS OF
THE STATE AT THE END OF THE FISCAL YEAR.
REVISOR'S NOTE: This section is new language
derived from Art. 48, §§ 132(b) and 136(e) of
the Code. The second sentence of this
section is added by amendment to indicate
explicitly that any funds unexpended at the
end of the fiscal year shall revert to the
general funds of the State.
