DYING, DISABLED, OR DISEASED POULTRY, OR PARTS OF ANY
CARCASS OF POULTRY, THAT DIED OTHERWISE THAN BY
SLAUGHTER.

REVISOR'S NOTE: This section is new language
derived from Art. 43, §197-12(c) of the
Code. The phrase "whether intended for
human food or other purposes" is proposed
for deletion because it is superfluous.

Art. 43, §197-12(c) is proposed for
deletion because its substance appears as
§4-213.

The only other changes made are in style.

SEC. 4-214. SALE, PURCHASE, OR TRANSPORTATION OF
POULTRY THAT DIED OTHERWISE THAN BY SLAUGHTER
PROHIBITED; EXCEPTIONS.

NO PERSON ENGAGED IN THE BUSINESS OF BUYING,
SELLING, OR TRANSPORTING IN INTRASTATE COMMERCE ANY
DEAD, DYING, DISABLED, OR DISEASED POULTRY, OR ANY
PART OF THE CARCASS OF ANY POULTRY THAT DIED OTHERWISE
THAN BY SLAUGHTER, MAY BUY, SELL, TRANSPORT, OFFER FOR
SALE OR TRANSPORTATION, OR RECEIVE FOR TRANSPORTATION
IN INTRASTATE COMMERCE THE POULTRY OR PART OF THE
CARCASS, UNLESS THE TRANSACTION OR TRANSPORTATION IS
MADE PURSUANT TO THE DEPARTMENTAL RULES AND
REGULATIONS.

REVISOR'S NOTE: This section presently appears as
Art. 43, §197-12(d) of the Code. The last
phrase is proposed for deletion because it
is assumed that any rule or regulation
adopted under this subtitle is intended to
effectuate the purposes of the subtitle.
The only other changes made are in style.

SEC. 4-215. BUSINESSES REQUIRED TO MAINTAIN RECORDS;
INSPECTION OF RECORDS.

(A) BUSINESSES REQUIRED TO MAINTAIN RECORDS.

EACH PERSON SHALL MAINTAIN RECORDS NECESSARY TO
INSURE THAT ADULTERATED OR MISBRANDED PRODUCTS ARE NOT
DISTRIBUTED TO CONSUMERS, FOR A PERIOD THE SECRETARY
PRESCRIBES WHICH MAY NOT EXCEED TWO YEARS UNLESS THE
SECRETARY SHOWS GOOD CAUSE, IF THE PERSON ENGAGES IN
AMY OF THE FOLLOWING BUSINESSES IN OR FOR INTRASTATE
COMMERCE:
