REVISOR'S NOTE: This section presently appears as
Art. 43, §197-25 of the Code. The last
sentence is proposed for deletion because
it is superfluous. The only other changes
are made in style.

SEC. 4-208. SANITARY PRACTICES AT OFFICIAL
ESTABLISHMENTS; REFUSAL TO INSPECT NON-COMPLYING
ESTABLISHMENTS.

(A) SANITARY PRACTICES AT OFFICIAL
ESTABLISHMENTS.

EACH OFFICIAL ESTABLISHMENT SHALL HAVE ITS
PREMISES, FACILITIES, EQUIPMENT, AND OPERATION IN
ACCORDANCE WITH SANITARY PRACTICES REQUIRED BY
DEPARTMENTAL RULES AND REGULATIONS.

(E) REFUSAL TO INSPECT NON-COMPLYING
ESTABLISHMENTS.

THE SECRETARY SHALL REFUSE TO INSPECT ANY

ESTABLISHMENT WHOSE PREMISES, FACILITIES, EQUIPMENT,

OR OPERATION FAILS TO MEET THE REQUIREMENTS OF THIS
SECTION.

REVISOR'S NOTE: This section presently appears as
Art. 43, §197-8 of the Code. The clause of
the first sentence describing the
establishments subject to this section is
proposed for deletion. Only establishments
slaughtering poultry and poultry products
solely for intrastate commerce are subject
to inspection and, consequently, they are
the only establishments falling within the
definition of "official establishment"; See
§4—201(r). The last phrase of subsection
(a) is proposed for deletion because it is
unnecessary in light of the statement of
legislative intent set forth in §4-202.
The only other changes made are in style.
