REVISOR'S NOTE: This section is new language
derived from Art. 66C, §470K (a) of the
Code. The reference to "cattle, sheep,
swine, goats, horses, mules, or other
equines" in the present law is proposed for
deletion and "livestock" is substituted
therefor in light of the definition set
forth in §1-101(d).

The present phrase "whether intended for
human food or other purposes" as applied to
a livestock is omitted because it is
superfluous. Art. 66C, §470K(a) is
proposed for deletion because its substance
appears as new language in this section.

SEC. 4-120. RECORDS; ACCESS TO PREMISES AND RECORDS.

EVERY PERSON SUBJECT TO THE REQUIREMENTS OF THIS
SUBTITLE, WHETHER OR NOT REQUIRED TO BE LICENSED,
SHALL MAINTAIN RECORDS REQUIRED BY DEPARTMENTAL RULES
AND REGULATIONS. EACH PERSON, UPON NOTIFICATION BY
THE SECRETARY, SHALL AFFORD THE SECRETARY ACCESS TO
HIS PLACE OF BUSINESS AT ANY REASONABLE TIME; THE
OPPORTUNITY TO INSPECT THE FACILITIES, INVENTORY, AND
RECORDS; AND THE OPPORTUNITY TO COPY ANY RECORD AND
TAKE ANY REASONABLE SAMPLE OF INVENTORY UPON PAYMENT
OF ITS FAIR MARKET VALUE. ANY RECORD REQUIRED TO BE
MAINTAINED BY THIS SECTION SHALL BE MAINTAINED AT
LEAST FOR THE PERIOD OF TIME THE SECRETARY PRESCRIBES
BY RULE OR REGULATION.

REVISOR'S NOTE: This section presently appears as
Art. 66C, §470M(b) of the Code. The
reference to "representative of the Board"
is proposed for deletion because all
inspections are presently performed by the
Secretary and his employees. New language
derived from Art. 43, §197-12(b) is added
to permit the Department to take samples of
inventory upon payment of fair market
value. The only other changes made are in
style.

SEC. 4-121. STORAGE AND HANDLING OF LIVESTOCK
CARCASSES, AND MEAT FOOD CAPABLE OF USE AS HUMAN FOOD.

TO ASSURE THAT ARTICLES ARE NOT ADULTERATED OR
MISBRANDED WHEN DELIVERED TO THE CONSUMER, THE
SECRETARY, BY RULE OR REGULATION, MAY PRESCRIBE THE
CONDITIONS UNDER WHICH ANY LIVESTOCK CARCASS, ANY PART
