also is omitted and "Secretary" is
substituted to reflect the department
organization which includes the State
Veterinarian as a unit of the department.
Article 41, §§430, and 431 vests ultimate
responsibility for the administration of
this Article in the Secretary-
Subsection (b) (1) is new language suggested
by the Department and added to exempt
individual dealers employed by a livestock
market from the necessity of obtaining a
license. Since the purposes underlying the
licensing requirement are the maintenance
of records and regulation of sanitary
conditions, it is unnecessary to require
more than one person in an operation to
obtain a license. Subsection (b)(2) is new
language suggested by the Department to
exempt livestock market licensees who are
dealers from the dealer's license
requirement. Under this subparagraph, a
livestock market licensee is exempt only if
he sells livestock at the livestock market
he has licensed. This is not a substantive
change since under §3—305 he would be
required to submit records.
In subsection (d) the present law is
revised to make mandatory the issuance of
an identification card and the display of
the license in order to aid the enforcement
of this subtitle and to protect the buyer,
and incorporate the present department
practice. Since the licensee and his
agents may be involved in a selling
operation, identification cards are issued
to both. The display requirement, which is
common to many Maryland laws, also is added
to facilitate enforcement.
The only other changes made are in style.
SEC. 3-304. REFUSAL, SUSPENSION, REVOCATION OF
LICENSE.
THE SECRETARY MAY REFUSE TO ISSUE A LICENSE OR
MAY SUSPEND OR REVOKE A LICENSE ON ANY OF THE
FOLLOWING GROUNDS:
(1) FRAUDULENT OR DECEPTIVE STATEMENT ON
