sales agency is irrelevant for the purposes
of this subtitle. Consequently, the
present nomenclature is proposed for
deletion and only the term "livestock
dealer" is used in this subtitle to refer
to any person who is in the business of
selling livestock.

(C)    "LIVESTOCK" MEANS CATTLE, SWINE, SHEEP, OR
GOATS NOTWITHSTANDING ANY OTHER PROVISION OF THIS
ARTICLE.

REVISOR'S NOTE: This subsection presently appears
as Art. 66C, §435(b) of the Code. The
reference to "live animals of beef or
dairy" cattle is proposed for deletion
because it is included within the reference
to "cattle". New language is added to
provide that this definition supersedes the
definition of livestock set forth in
§1-101 (e). The only other changes made are
in style.

(D)    "LIVESTOCK MARKET" MEANS AN ESTABLISHED
LOCATION WHERE LIVESTOCK ARE ASSEMBLED, WEIGHED,
GRADED, AND OFFERED FOR SALE AT ANY TIME.

REVISOR'S NOTE: This subsection is new language
derived from Art. 66C, §435 (e) of the Code.
The term "livestock auction market" is
omitted throughout this subtitle for
organizational purposes. The definition is
identical to the present definition of
"livestock market".

(E)   "TRUCKER OR HAULER" MEANS A PERSON WHO
ENGAGES IN THE BUSINESS OF TRANSPORTING LIVESTOCK IN
TRUCKS OR OTHER CONVEYANCES TO OR FROM A FARM, A
LIVESTOCK AUCTION, SALES AGENCY, OR DEALER'S PREMISES.

REVISOR'S NOTE: This subsection presently appears
as Art. 66C, §435(f) of the Code. The only
other changes made are in style.

SEC. 3-302. LICENSE FEES CONSTITUTE A FUND.

THE LICENSE FEES RECEIVED BY THE SECRETARY

PURSUANT TO §3-303 CONSTITUTE A FUND TO DEFRAY

PARTIALLY EXPENSES INCURRED IN ADMINISTERING THIS
SUBTITLE.
