UPON REQUEST OF ANY GOVERNMENTAL UNIT OR
POLITICAL SUBDIVISION OF THE STATE, THE SECRETARY
SHALL CONDUCT REQUESTED TESTS AND INVESTIGATIONS OF
ANY BIOLOGICAL PRODUCT FOR PUBLIC PURPOSES.
REVISOR'S NOTE: Subsection (a) is new language
giving the department explicit authority to
conduct tests, investigations, and research
operations on its own initiative.
Subsection (b) is new language derived from
Art. 66C, §462 of the Code. The present
provision that tests and investigations
shall be conducted upon request of the
State Board of Health, the now extinct
State Board of Agriculture, or the State
Veterinarian is omitted here. This
subsection is revised so that any state
unit or political subdivision may test and
investigate. Finally, the last phrase of
Art. 66C, §462 is omitted because it is
assumed that the department functions
within its budget.
SEC. 3-205. SALE OF BIOLOGICAL PRODUCTS BY THE
DEPARTMENT.
THE SECRETARY MAY SELL ANY BIOLOGICAL PRODUCT TO
ANY LICENSED PHYSICIAN OR VETERINARIAN. THE SECRETARY
MAY CHARGE A FEE TO COVER THE APPROXIMATE COST OF
PRODUCING THE BIOLOGICAL PRODUCT.
REVISOR'S NOTE: This section presently appears as
Art. 66C, §461 of the Code. The only
changes made are in style.
SEC. 3-206. EXPERIMENTS WITH CONSENT OF SECRETARY.
NOTWITHSTANDING ANY OTHER PROVISION OF THIS
SUBTITLE, THE SECRETARY MAY AUTHORIZE ANY PERSON NOT
CONNECTED WITH THE STATE LABORATORY HE DEEMS QUALIFIED
TO MAKE EXPERIMENTS WITH ANY BIOLOGICAL PRODUCT.
REVISOR'S NOTE: This section presently appears as
Art. 66C, §457 of the Code. New language
is added to this section to indicate that a
person who conducts experiments with the
consent of the department is not subject to
the prohibitions of this subtitle. The
last phrase of the present section is
proposed for deletion because it is
