REVISOR'S NOTE: This subsection is new language
set forth here to indicate the precise
meaning of "biological product", a term
used throughout this subtitle.

SEC. 3-202. APPLICABILITY OF SUBTITLE.

THIS SUBTITLE DOES NOT APPLY TO ANY ACT THAT IS
SUBJECT TO EXCLUSIVE PECULATION UNDER ANY FEDERAL ACT.

REVISOR'S NOTE: This section is new language set
forth here to indicate to the Code user
that the provisions of this act may be
superseded by any federal act which
exclusively regulates the area. The
Federal Virus, Serum, Toxin, Antitoxin, and
Analogous Products Act (21 U.S.C. §151, et
seq.) does not exclusively regulate the
sale and distribution of biological
products.

SEC. 3-203. BIOLOGICAL PRODUCTS LABORATORY.

(A) SECRETARY MAY ESTABLISH BIOLOGICAL PRODUCTS
LABORATORY.

THE SECRETARY MAY ESTABLISH, EQUIP, AND SUPERVISE
A BIOLOGICAL LABORATORY FOR PRODUCING ANY BIOLOGICAL
PRODUCT IN THE STATE AND [[TO INVESTIGATE AND TEST]]

FOR INVESTIGATING AND TESTING BIOLOGICAL METHODS AND

PRODUCTS FOR TREATING LIVESTOCK AND POULTRY DISEASES.

(B) COOPERATION WITH THE UNIVERSITY OF MARYLAND.

THE SECRETARY MAY COOPERATE WITH THE UNIVERSITY
OF MARYLAND TO PREPARE, TEST, USE, AND DISTRIBUTE
BIOLOGICAL PRODUCTS.

REVISOR'S NOTE: Subsection (a) presently appears
as Art. 66C, §459 of the Code. The present
references to specific biological products
are proposed for deletion in this and
subsequent sections of this subtitle since
they all are encompassed within the
definition of "biological product" set
forth in §3—201. The present phrase
"needed for diagnosing, preventing,
immunizing against and curing" is proposed
for deletion because the definition of
"biological product" indicates its
purposes.
