(B) APPOINTMENTS.
THE SECRETARY SHALL APPOINT THE STATE CHEMIST,
STATE VETERINARIAN, AND STATE SUPERINTENDENT OF
HEIGHTS AND MEASURES. THE SECRETARY SHALL APPOINT THE
INSPECTOR OF TOBACCO WITH THE APPROVAL OF THE
GOVERNOR.
(C) OTHER POSITIONS OR UNITS.
THE DEPARTMENT ALSO INCLUDES ANY OTHER POSITION
OR UNIT WHICH IS DECLARED WITHIN THE DEPARTMENT
PURSUANT TO LAW.
REVISOR'S NOTE: Subsections (a) and (c) presently
appear as Art. 41, §431 of the Code. The
term "unit" is used as the general
nomenclature for the organization and
structure within the department because it
has a broad and nondescript connotation.
Terms such as agency, board, office, are
avoided due to their substantive meanings.
The present provision which includes the
"Wholesome Poultry Advisory Council of
Maryland" as a unit of the Department is
proposed for deletion because this Council
was discontinued statutorily on July 1,
1973. Subsection (b) is new language
derived from Art. 48, §§ 9, 117, 129; Art.
66C, §437(a); and Art. 97, §4 and is set
forth here for organizational purposes.
The only other changes made are in style.
SEC. 2-107. TRANSFER OF JURISDICTION OF AUTHORITY AND
ACTS OF FORMER UNITS TO DEPARTMENT.
EVERY RULE, REGULATION, FORM, ORDER, AND
DIRECTIVE ADOPTED BY OR IN EFFECT FOR ANY POSITION OR
UNIT ASSIGNED TO THE DEPARTMENT, OR FOR ANY ABOLISHED
POSITION OR UNIT WHOSE FUNCTIONS HAVE BEEN TRANSFERRED
