1422                                        LAWS OF MARYLAND                             [Ch. 6

(C)   APPOINTMENT, REMOVAL, AND SALARY OF THE
DEPUTY SECRETARY.

THE SECRETARY, WITH THE APPROVAL OF THE
GOVERNOR, SHALL APPOINT A DEPUTY SECRETARY WHO HAS THE
DUTIES PROVIDED BY LAW OR DELEGATED BY THE SECRETARY.
THE DEPUTY SECRETARY SERVES AT THE PLEASURE OF THE

SECRETARY AND [[RECEIVES]] SHALL RECEIVE THE SALARY

PROVIDED IN THE STATE BUDGET.

(D)      APPOINTMENT, REMOVAL, AND SALARY OF
ASSISTANTS, CONSULTANTS, AND OTHER PERSONNEL.

THE SECRETARY ALSO SHALL HAVE WITHIN THE
DEPARTMENT ASSISTANTS, PROFESSIONAL CONSULTANTS, AND
EMPLOYEES AS PROVIDED IN THE STATE BUDGET. ASSISTANTS
IN CHARGE OF AREAS OF RESPONSIBILITY AND PROFESSIONAL
CONSULTANTS SERVE AT THE PLEASURE OF THE SECRETARY.
WHEREVER IT IS PROVIDED BY LAW THAT THE SECRETARY
MAKES AN APPOINTMENT TO A PARTICULAR OFFICE WITHIN THE
DEPARTMENT WITH THE APPROVAL OF THE GOVERNOR, THE
SECRETARY MAY NOT REMOVE THE APPOINTEE WITHOUT FIRST
OBTAINING THE GOVERNOR'S APPROVAL. UNLESS OTHERWISE

PROVIDED, [[HE]] THE SECRETARY SHALL APPOINT AND

REMOVE ALL OTHER PERSONNEL IN ACCORDANCE WITH THE
PROVISIONS OF THE STATE MERIT SYSTEM LAW. THE
SECRETARY MAY DELEGATE THE AUTHORITY TO APPOINT AND
REMOVE PERSONNEL OF ANY UNIT TO THE ADMINISTRATOR OF
THE UNIT.

REVISOR'S NOTE: This section presently appears as
Art. 41, §430 of the Code. The first
sentence of subsection (a) is proposed for
deletion in light of proposed §2-101. The
second sentence of subsection (d) is new
language derived from present Art. 41,
§435(f) and placed here for organizational
purposes. The last sentence of subsection
(b) is new language derived from similar
language pertaining to the Secretary of
Natural Resources in Art. 41, §232 (b) added
to promote more efficient administration
within the department. The only other
changes made are in style.

SEC. 2-103. GENERAL POWERS AND DUTIES OF SECRETARY.
(A) BUDGET.

THE SECRETARY IS RESPONSIBLE FOR THE BUDGET OF
HIS OFFICE AND FOR THE BUDGETS OF POSITIONS AND UNITS
