142                                        LAWS OF MARYLAND                            [Ch.

sec. 3-804. exclusive original jurisdiction.

(a)      the court has exclusive original
jurisdiction over a child alleged to be:

(1)  delinquent;

(2)  dependent;

(3)   neglected;

(4) in need of supervision; or
(5) mentally handicapped.

(b)     the court has exclusive original
jurisdiction over proceedings arising under the
interstate compact on juveniles.

REVISOR'S NOTE: This section is new language
derived from Art. 26, §70-2 (a) except the
excluding provisions which grant
jurisdiction over a person who causes a
child to be adjudicated, neglected,
delinquent, or in need of supervision.
These provisions are placed in a new
section.

SEC. 3-805. JURISDICTION OVER ADULTS.

(A)   IN GENERAL.

THE COURT HAS EXCLUSIVE ORIGINAL JURISDICTION
OVER [[AN ADULT WHO IS CHARGED WITH WILLFULLY
CONTRIBUTING TO, ENCOURAGING, OR TENDING TO CAUSE BY
ANY ACT OR OMISSION, ANY CONDITION WHICH WOULD RENDER
A CHILD NEGLECTED, DELINQUENT, OR IN NEED OF
SUPERVISION.]] AN ADULT WHO IS CHARGED WITH COMMITTING

A WILLFUL ACT OR OMISSION CAUSING A CHILD TO BE

ADJUDICATED NEGLECTED, DELINQUENT, OR IN NEED OF

SUPERVISION.

(B)   ELECTION BY ADULT.

[[THE]] A DEFENDANT CHARGED IN THE JUVENILE COURT
UNDER SUBSECTION (A) MAY ELECT TO BE TRIED EITHER IN
THE JUVENILE COURT OR IN THE CRIMINAL COURT ACCORDING
TO THE USUAL CRIMINAL PROCEDURE.
