Subsection (h) of §3—801 is the substance
of Art. 26, §51(b) with necessary inclusion
of the Circuit Courts of Baltimore City.

Subsection (u) inserts a definition
identical with that contained in Maryland
Rule 901 (a) (2) . It is slightly different
from Art. 26, §70-1 (e).

Subsection (x) is new and included as a
result of the legislative change in Art.
26, §71A dealing with civil liability of
parent and child in juvenile causes.

Subsection (y) reflects the change made by
H.B. 31, Ch. 747, Acts of 1973, to include
two further adjudications of a minor's
status within the definition of "protective
supervision".

Definitions of "child", "child in need of
supervision", and "mentally handicapped
child" are revised with view to similar
definitions in §4-501 of Title 4.

The only other changes made are in style.
SEC. 3-802. PURPOSES OF SUBTITLE.

(A) THE PURPOSES OF THIS SUBTITLE ARE:

(1)    TO PROVIDE FOR THE CARE, PROTECTION,
AND WHOLESOME MENTAL AND PHYSICAL DEVELOPMENT OF
CHILDREN COMING WITHIN THE PROVISIONS OF THIS
SUBTITLE;

(2)   TO REMOVE FROM CHILDREN COMMITTING
DELINQUENT ACTS THE TAINT OF CRIMINALITY AND THE
CONSEQUENCES OF CRIMINAL BEHAVIOR;

(3)   TO PROVIDE FOR A PROGRAM OF TREATMENT,
TRAINING, AND REHABILITATION CONSISTENT WITH THE
PROTECTION OF THE PUBLIC INTEREST;

(4)   TO PLACE A CHILD IN A WHOLESOME FAMILY
ENVIRONMENT WHENEVER POSSIBLE;

(5)    TO SEPARATE A CHILD FROM HIS PARENTS
ONLY WHEN NECESSARY FOR HIS WELFARE OR IN THE INTEREST
OF PUBLIC SAFETY;
