REVISOR'S NOTE: Paragraph (1) of this subsection
is new language derived from Article 66C,
section 168(a) of the Code and is set forth
here for organizational purposes.
Paragraph (2) is new language derived from
the second sentence of Article 66C, section
168 (a) of the Code.
Paragraph (3) presently appears as Article
66C, section 170 of the Code. New language
derived from the last paragraph of section
169(a) is added for organizational
purposes.
Paragraph (4) presently appears as Article
66C, section 169(a) of the Code. New
language is added to indicate that the
Natural Resources Police Force specifically
is charged with enforcing the Natural
Resources laws and that any other law
enforcement officer is authorized to do so.
The last paragraph is proposed for deletion
because it duplicates proposed paragraph
(1).
The only other changes made are in style.
(D) RIGHT OF SHOREOWNERS TO ESTABLISH EXCLUSIVE
SITE FOR GUNNING RIG. - ANY PERSON WHO IS A RIPARIAN
OWNER ON THE CHESAPEAKE BAY OR THE NORTHEAST RIVER
ADJACENT TO THE LINES DEFINED IN THIS SECTION, OR HIS
ASSIGNEE, MAY SELECT AND MARK IN OCTOBER OF EACH YEAR
ANY POINT ON HIS SHORELINE AS RESERVED FOR HIS
GUNNING. THE OWNER OR HIS ASSIGNEE SHALL HAVE
EXCLUSIVE RIGHT DURING OPEN SEASON TO STATION A
GUNNING RIG OR CRAFT, OR SET DECOYS, AND GUN WITHIN
ONE-QUARTER MILE FROM THE SHORELINE. THE QUARTER MILE
LINE SHALL RUN AT RIGHT ANGLES TO THE SHORELINE FROM
THE POINT SO DESIGNATED OR SELECTED BY THE LANDOWNER.
