66C, section 159(c) and (d) of the Code.
The present provisions provide for
inspection of blind sites only and omit any
reference to inspection of stationary blind
sites. At the present time, however, the
department inspects the validity of
stationary blind applications. If it finds
an erroneous one, it will forbid any
hunting from the blind.
10-615. MARKING BLIND SITE; LOSS OR DESTRUCTION OF
STAKE; REMOVAL.
(A) MARKING BLIND SITE REQUIRED. - ANY PERSON
CHOOSING A LOCATION FOR A STATIONARY BLIND OR BLIND
SITE PURSUANT TO THE PROVISIONS OF THIS SECTION SHALL
MARK THE POSITION BY ERECTING A STAKE SHOWING THE
LICENSEE'S NAME AND NUMBER.
(E) LOSS OR DESTRUCTION OF BLIND OR BLIND SITE.
- IF ANY LICENSEE ERECTS A STATIONARY BLIND OR BLIND
SITE OR SETS A STAKE AND IT IS LOST OR DESTROYED IN
ANY MANNER BEYOND HIS CONTROL, HE SHALL NOT LOSE HIS
LOCATION BUT MAY REESTABLISH IT AT ANY TIME DURING THE
CURRENT HUNTING SEASON.
(C) RESIDENT REQUIRED TO REMOVE STAKE AFTER
SEASON CLOSES. - A RESIDENT WHO IS NOT A RIPARIAN
OWNER AND WHO ERECTS A BLIND SITE AFTER OCTOBER 21
SHALL REMOVE ANY STAKE ERECTED PURSUANT TO THE
PROVISIONS OF THIS SECTION WITHIN 30 DAYS AFTER WILD
WATERFOWL SEASON CLOSES.
REVISOR'S NOTE: Subsection (a) is new language
derived from similar provisions of Article
66C, section 154(a), (b) , and (c) of the
Code.
Subsection (b) presently appears as Article
66C, section 154(f) of the Code. New
language is added to reflect the new
definition of stationary blind and blind
site.
Subsection (c) is new language derived from
the last sentence of Article 66C, section
159(d) of the Code. The present reference
to the licensee's agent is not included
because this subsection only requires that
the licensee remove it and consequently
allows the agent to remove it.
