THE NEST, OR EGGS OF ANY GAME BIRD OR MAMMAL.

(D) KILLING CATS HUNTING GAME BIRDS AND MAMMALS
AND PROTECTED BIRDS PERMITTED; DUTY OF NATURAL
RESOURCES POLICE OFFICER. - A NATURAL RESOURCES POLICE
OFFICER OR ANY LAW ENFORCEMENT OFFICER SHALL AND ANY
OTHER PERSON MAY DESTROY ANY CAT FOUND HUNTING ANY
GAME BIRD OR MAMMAL OR PROTECTED BIRD OR MAMMAL. A
CAUSE OF ACTION FOR DAMAGES CANNOT BE MAINTAINED FOR
THIS ACT.

REVISOR'S NOTE: Subsection (a) presently appears
as Article 66C, section 132(h) of the Code.
The reference to "partridge" is proposed
for deletion because, as presently used, it
is intended to refer to "quail". See
revisor's note appearing at proposed
section 10-101(u).

New language is added to indicate that this
subsection is subject to the exceptions of
the gun control act, Chapter 13, Acts of
1972. The provision relating to the
display of hunting tags is proposed for
deletion because Chapter 281, Acts of 1972,
eliminated this requirement. New language
is added to indicate that the attendant
must have his license when training.

The remaining subsections presently appear
as Article 66C, section 132 (i) of the Code.
The penalty provision is proposed for
deletion in light of the uniform penalty
provision of this title. References to
Natural Resources Police officers and any
law enforcement officer are added where
appropriate. Chapter 348, Acts of 1972
specifically charged the Natural Resources
Police Force with enforcing the natural
resources laws of the State and any law
enforcement officer also has this
authority. The phrase "game birds or
mammals or protected birds" is added
because this section probably was intended
to refer to these species. Game birds and
mammals are protected to the extent that
hunting seasons are established for them.

The only other changes made are in style.
