section is revised to include "mergansers"
in order to comply with the federal
regulations which include this specie in
the definition of "wild waterfowl". See 50
C.F.R., section 1.11.
10-408. DEPARTMENT TO REGULATE USE OF WEAPONS AND
AMMUNITION.
THE DEPARTMENT SHALL PRESCRIBE BY RULE OR
REGULATION THE MEANS OR WEAPONS FOR HUNTING DESIGNATED
WILDLIFE PURSUANT TO THE PRIVILEGES GRANTED BY A
HUNTER'S LICENSE. THE DEPARTMENT SHALL SET FORTH ANY
RESTRICTIONS RELATING TO WEAPONS USED TO HUNT
DESIGNATED WILDLIFE INCLUDING BUT NOT LIMITED TO THE
AMOUNT AND SIZE OF AMMUNITION FOR DESIGNATED GAME
BIRDS OR MAMMALS. THE DEPARTMENT SHALL MAKE THE RULES
AND REGULATIONS AVAILABLE FOR DISTRIBUTION WITH EACH
HUNTING LICENSE PURCHASED. THIS SECTION DOES NOT
AUTHORIZE THE DEPARTMENT TO RESTRICT THE USE OF
FIREARMS EXCEPT IN THE EXERCISE OF THE PRIVILEGES OF A
HUNTING LICENSE.

Article 66C, section 132(f) of the Code.

10-409. DEPARTMENT SHALL REGULATE BAG LIMITS;
CONFORMITY WITH FEDERAL RULES AND REGULATIONS.
PURSUANT TO §10-205, THE DEPARTMENT SHALL
ESTABLISH AND PUBLISH BY APRIL 25 EACH YEAR THE BAG
LIMITS PER DAY 70S GAME BIRDS AND MAMMALS BY RULE OR
REGULATION FOR THE ENSUING YEAR. THE BAG LIMITS FOR
DUCKS, GEESE, BRANT, RAILBIRDS, WOODCOCK, MERGANSERS,
DOVES, AND SNIPE MAY CONFORM TO THE FEDERAL MIGRATORY
BIRD RULES AND REGULATIONS ADOPTED ANNUALLY BY THE
SECRETARY OF INTERIOR OF THE UNITED STATES.
REVISOR'S NOTE: This section presently appears as
Article 66C, section 133 of the Code. The
term "jacksnipe" is proposed for deletion
and "snipe" substituted therefor. The two
terms are synonymous but only the term
"snipe" is being used to avoid confusion.
New language is added to indicate the
federal identity of the Secretary of
Interior. The only other changes made are
in style.
