(C) "WATERSHED" MEANS THE PATUXENT RIVER
WATERSHED.

REVISOR'S NOTE: This subsection is new language
to avoid the repetitive use of the phrase
"Patuxent River Watershed".

8-1302. LEGISLATIVE FINDINGS.

THE GENERAL ASSEMBLY DECLARES THAT FLOOD
PREVENTION, CONSERVATION, SEDIMENT OR EROSION
PROTECTION, AND PREVENTION OF URBAN DEVELOPMENT
[[WITH]] WITHIN THE WATERSHED IS A PUBLIC BENEFIT AND
CONDUCIVE TO THE PUBLIC HEALTH, SAFETY AND WELFARE.

REVISOR'S NOTE: This section is new langauge
derived from the last clause of Article
66C, section 411A(a) of the Code and set
forth here for organizational purposes.

8-1303. APPROPRIATE COUNTY GOVERNING BODY MAY CREATE
PATUXENT RIVER WATERSHED.

THE APPROPRIATE COUNTY GOVERNING BODY OF HOWARD,
MONTGOMERY, PRINCE GEORGE'S, ANNE ARUNDEL, CALVERT,
CHARLES AND ST. MARY'S COUNTIES OR THE DULY DESIGNATED
AGENCIES OF THE APPROPRIATE COUNTY GOVERNING BODY
HAVING THE JURISDICTION, POWER, AND AUTHORITY TO
DEFINE AND CREATE THE PATUXENT RIVER WATERSHED IN
THEIR RESPECTIVE COUNTIES. EACH SHALL ACT
COOPERATIVELY WITH THE DEPARTMENT AND LOCAL, COUNTY,
STATE, AND FEDERAL GOVERNMENTS TO PROTECT AREAS
SUBJECT TO SEDIMENT OR EROSION DAMAGE AND PREVENT
ENCROACHMENT BY RAPID GROWTH AND SPREAD OF URBAN
DEVELOPMENT BY CREATING A PROGRAM OF FLOOD PREVENTION
AND CONSERVATION.

REVISOR'S NOTE: This section presently appears as
Article 66C, section 411A(a) of the Code.
The reference to "Department of Forests and
Parks" is proposed for deletion and
"department" substituted therefor in light
of the nomenclatural changes of Chapter
348, Acts of 1972. The last clause is
proposed for deletion because its substance
appears in section 8—1302. The only other
