REVISOR'S NOTE: This section presently appears as
Article 14B, section 12F (a) through (e)
inclusive of the Code. This first sentence
is added to clarify the establishment on
the outset of the Waterways Improvement
Fund.

Subsection (1) and (3) include amendments
added by Chapter 701, S.B. 680, Acts of
1973.

Subsections (5) and (6) presently appear as
Article 14B, section 12F(f) and (g) as
enacted by Chapter 826, S.B. 118, Acts of
1973.

The only other changes made are in style.
6-708. FINANCING PROJECTS.

(A) PROJECTS FOR DREDGING AND MASKING CHANNELS
AND HARBORS, CONSTRUCTION OF JETTIES AND BREAKWATERS,
AND CLEARING DEBRIS, AQUATIC VEGETATION, AND
OBSTRUCTIONS IN NAVIGABLE WATERS AS WELL AS
CONSTRUCTION OF MARINE FACILITIES LOCATED WITHIN LANDS
OWNED BY THE STATE DEPARTMENT OF NATURAL RESOURCES
SHALL BE FINANCED SOLELY BY THE WATERWAYS IMPROVEMENT
FUND. ANY FUNDS AVAILABLE FROM THE FEDERAL
GOVERNMENT, ANY GOVERNING BODY, OR ANY GIFT ALSO MAY
BE USED FOR THESE PURPOSES.

REVISOR'S NOTE: This subsection presently appears
as Article 14B, section 12G(a) of the Code,
as amended by Chapter 237, S.B. 698, Acts
of 1973. The word "donation" is proposed
for deletion because it duplicates the word
"gift". It is intended that the provisions
of Article 15A, section 5 are applicable to
this section. The only other changes made
are in style.

(E) THE GOVERNING BODY AND THE WATERWAYS
IMPROVEMENT FUND JOINTLY SHALL FINANCE PROJECTS TO
CONSTRUCT MARINE FACILITIES BENEFICIAL TO THE BOATING
PUBLIC. THE CONTRIBUTION OF THE WATERWAYS IMPROVEMENT
FUND SHALL BE LIMITED TO NOT MORE THAN 50 PERCENT OF
THE COST OF EACH PROJECT. HOWEVER, THE WATERWAYS
IMPROVEMENT FUND MAY FINANCE COMPLETELY ANY
CONSTRUCTION PROJECT BENEFICIAL TO THE BOATING PUBLIC
WHICH COSTS LESS THAN $25,000 REGARDLESS OF ITS
LOCATION.
